I rented a storage unit from Mr. Debonis on February 18. I would be needing the unit for 3 1/2 months so I prepaid for four months. Jim, the office worker assisting me, advised there were no partial month refunds. I understood that.
On February 19 the domestic violence shelter where I was staying advised me that my abuser had located me and I had to move out. My only option was to move out of the state to my parents home in Tennessee.
I went to the storage facility on February 20 and removed all of my belongings prior to noon that day. I advised Jim of the situation, he said Mr. DeBonis was a good man, I should call him and explain the situation and he would give me some of my money back. I paid a $20 deposit that should be refundable when the unit is emptied and swept out. I did this and no deposit has been returned to me. I believe that I should be due at least three months rent refund.
At $80 per month that is $240. So in the least I should be due $260 dollars. The day I rented I gave Jim $340.00 cash for deposit and 4 months rent. I have called Mr. DeBonis he states he never told me he would send me anything.
I had two phone conversations with him. During the first he said to "leave a forwarding address with Jim and I will send you something. You should have planned better this is ridiculous".
The second phone call all Mr. DeBonis did was yell and ask if I left an address with Jim. I have recieved no refund and don't know what to do at this point. Many people have told me that New Mexico has a three day rule on contracts, that they can be cancelled and fully refunded if done so within three business days.
My belongings weren't even in the storage unit for a full 48 hours. What should I do from this point? I am a single mother trying to start over so $260 is alot of money to me. Please help.
