Cardenas Toyota will violate the Texas Deceptive Trade Practices Act 17.46. (i.E., breaching a warranty)

I took my 2005 Toyota Camry to Cardenas Toyota, of Harlingen TX, for service on an ABS Light that was turning on. The diagnostic reading said that the left rear speed sensor was no good. Subsequently, the service technician told me that I would be charged approximately $202.04 for these parts and service -which were supposed to be covered under my Toyota-Extra-Care-Plan warranty - so I declined further service. As a result, I had to wait until early November -because of work constraints - to reasonably mitigate this breach of warranty; thus, I had to incur further economic damages by driving all the way to Champion Toyota of Austin, TX, (dealership where I originally purchased my vehicle) to finally get my vehicle serviced. Rightfully, the national warranty was honored and I was not charged.

On December 10, I contacted Cardenas Toyota to understand why I had been charged $80.00 for diagnostic repairs that were supposed to be covered under the warranty. I spoke with a service assistant, Elizabeth, who told me that she would look further into it.

The following day, at around 4:30 P.M., I called back and she (Elizabeth) stated, [that she] already spoke to management and we cannot refund your money back. As a result, I asked to speak with management, myself, which is when I realized that it was a ruse and no such contact had ever been made between Joseph Zebrowski (service management) and her.in my conversation with Joseph Zebrowski, I was told that I would have to wait an additional day because there was a workers party occurring at the dealership and that the computers had closed at around 5:15 P.M.

On December 13, at around 7:00 A.M., Joseph Zebrowski returned my call and was staunch about not refunding my fee for the diagnostic service that was supposed to be covered under the national warranty.in furtherance, I was told that I was charged eighty dollars for the diagnostic repairs because I denied paying approximately two hundred and two dollars for the parts.

In light of this, with the advice of my son (who is a law student at the University of Nebraska College of Law), I promptly addressed the Texas Attorney Generals Office and the Better Business Bureau (who have already documented his unscrupulous behavior) of this unlawful breach of warranty/violation of the Texas Deceptive Trade Practices Act so that other unsuspecting patrons may be warned of Joseph Zebrowkis unscrupulous/unlawful acts at Cardenas Toyota.

As a result of Joseph Zebrowskis egregious failure to rectify the breach of warranty, which violates the Texas Deceptive Trade Practices Act, I am currently in the process of seeking further legal redress (i.E., filing a petition) for economic and expectation damages (i.E., position I would have been had the contract been performed) with the Justice of the Peace Small Claims Court in Cameron County, TX.
