On February I purchased a Classic 1972 BMW 3.0 CSI automobile on eBay. The car was advertised as a restored near perfect vehicle that had no rust and needed absolutely nothing. Little did I know this was the beginning of a nightmare transaction where the owner of Bimmer Classics conspired with his wife, forged title documents, misrepresenting the condition and mileage of the car which has amounted to deceptive acts and nothing short of fraudulent activity on a criminal level.
The owner claimed the car was absolutely beautiful, something he has searched 8 years to find and nothing short of the highest 10 out of 10 rating. He mentioned that it was completely rust free and needed absolutely nothing then went into his years of experience with BMW's. Based on the price of the car, written advertisement, expertise and eBay ratings of the seller, I felt lucky and did not suspect any foul play.
I received the car on 2 week later. For Mr. David Foree to make claims in his ad that this was a restored vehicle that needed nothing was pathetic. Within 20 minutes of looking at the car, I noticed the following things either missing or not working;
1) Windshield rubber gasket was torn at the seam
2) Front sway bar missing
3) Radio not working amplifier was missing
4) Auto Antenna not engaging
5) Both rear windows would not roll down
6) Front hood latch was missing
7) Driver side carpet worn thru
8) Rusted Floor boards and trunk
After several messages, Mr. David Foree called me back. I asked for a refund of my money as the car was misrepresented or incorrectly stated the condition of the car. He disagreed and claimed he did not have the money anymore so a refund would not happen! He claimed for the item missing that $500 - $600 should cover it and to take the car to a qualified mechanic and then to Best Buy for the electronic issues so he could reimburse me. I finally received the title. Upon reviewing the actual title I noticed that Mr. David Foree's name was no longer listed as his fax indicated and that the transfer of ownership would come directly from a dealership named Bimmer Classics.
Per the BMW shop, the car had major issues and they deemed the body to be worthless as it had excessive structural rust issues in the floor boards, firewall and in lower rocker panels. Mechanically the car was assessed as dangerous and a fire hazard due to the incorrect fuel rail, fuel pressure regulator as well as wrong throttle body to name a few things. The work that this car required was extreme!
I again called Mr. David Foree and demanded a refund and that I would tender the car back to him and rescind the deal. But Mr. David Foree said that would not happen. I was not getting anywhere so I opened a formal eBay dispute. Mr. David Foree responded to the dispute and continued to claim the car was as advertised, while at the same time he also admitted he never fully inspected it either.
I started gathering information about Mr. David Foree. I was astounded at what started to unfold. I found out that Mr. David Foree was not only in the automobile industry but the owner / president of Bimmer Classics out of Marietta, GA (lic. # ucar034592). Bimmer Classic's eBay account "shortphatguy" had many negative feedbacks from other buyers and then was closed by eBay. Apparently this was not the first time Bimmer Classics had their eBay account closed as he operated under "bimmerclassics" in the past with similar negative ratings.
EBay is a tight community network, where transactions are binding contracts and both buyers and sellers collaborate and leave feedback for each. Members have the ability to see past transaction history to determine the trading partner's creditability, trustworthiness and ratings from others. I would have never purchased the car from Bimmer Classics with their horrible eBay ratings. He circumvented me from knowing about his business Bimmer Classics by using his wife's eBay account and 100% positive feedback rating to perform my transaction.By using his wife's account and grossly misrepresenting the car in my transaction, he violated eBay User policy.
Right as you think it can't get any worse, the fraudulent activity by Mr. David Foree the owner of Bimmer Classics continued to surface. The car was advertised to have 39451 miles on the odometer. Actually the car was delivered with 13370 kilometers on the odometer. With a 5 digit mechanical limitation on the odometer, the car most likely has rolled over multiple times.
The reality of this situation is that Mr. David Foree the owner of Bimmer Classics took advantage of me in this transaction. He is an expert with older BMW's and not only imminently knew the valuation and potential problem areas of this classics automobile, but thru deceptive acts made false statements in his ad to attract unsuspecting buyers. According to past transactions, this appears to be common practice with many Bimmer Classic transactions.in my transaction, he conspired with his wife by using her eBay account which had a 100% positive feedback rating but then went further by grossly misrepresented the condition and worthiness as well. Not to mention that mileage was completely inaccurate and he also forged documents in order to collect my deposit payment.
I would warn anyone to be very careful or better yet avoid this business as they have a long standing history ripping people off.
