Jim Kizer Auto Sales
Dishonest, unethical, untrustworthy

On 4-3-06 I purchased a 2000 olds intrigue from Jim Kizer Auto Sales in Unoin City TN. The price agreed on was $5,500, I paid $2,000 down and agreed to make 16 monthly payments of $279.95. After making the second payment on 6-16-06. On 6-17-06 Mr. Kizer came to my moms house where myself, my wife, our 5 year old son, our 18 month old daughter, and our 6 month old nephew, where visiting.

He took off in the car which had the babys diaper bags, medicines and there car seats. I called him to ask what he was doing, He said that I had wrote him was on a closed acount which is not true that is the only checking account I have and it is still open to this day. He agreed to came back and let me clean out the car. He refused cash in leu of the check and said the only way I could get the car back was to pay the note in full. I said I would not do that. He then said in front of three witnesseshe would hold the car for fifteen days then sell it for $5,500 and I would get most of my $2,000 down payment back.

Over the next few weeks He refused three more offers of payment on the car one on 6-19-06,6-24-06, and on 7-6-06. While the car was suposidly in holding it was seen being driven by him and people in his family and people that worked for him by myself and several others He Sent a certified leter on 6-20 giving me till 7-1 to make payment or the car would go back on the lot. I recived that letter on 7-6-06 and he didn't even have the right car on the leter.

On 8-4-06 I contacted Mr Kizer and stated that I had noticed the car had been sold and wanted to make arrangments to get my refund. At that time Mr. Kizer stated that he purchased the car himself for my payoff and that I just lost that money. Yet I know he sold the car from he's lot for $5,500. Now this is at the very least unethical if not illeagal however the better business bureau has not been able to help me and the only lawyer that will take my case wants $1,500 so it's kinda pointless to take it too court, The BBB case # by the way is 40030483
