Ripoff Incompetance fraudulent handling of payments placeing current accounts in colections

In 2003 I obtained an auto loan from Key Bank. No problems or concerns with the loan for the first two years. The loan was purchased by Capital One in July. From the first contact I had with this company I have been frustrated and annoyed. Several months after purchasing the loan they finally sent me a statement. It was incorrect. My payments were 371.00 per month, yet the statements they sent indicated an amount due of 251.05. I called and asked why they were incorrect and was told, "I don't know. It's no big deal though. Just make your payment according to the statement." I am not dumb and was informed by Key Bank that when Capital One acquired the loan all aspects of the original contract would remain the same, so I continued to make my regular payments of 371.00. Although all payments were made via electronic payments from my bank and on time, I began seeing 10.00 dollar late fees charged to my account. Again I called and was told that they were there in error and would be removed.

The real trouble began in November, when I made a principal payment on the account at the same time I made the November and December payments. I made a 5000.00 principle payment (a late graduation present for my daughter, it's her car) and two regular payments for November and December. I was going to be out of the country for much of December and wanted to make sure that the payment was in on time.

Since then I have made all other payments on time in spite of the fact that Capital One stopped sending me monthly statements and applied the three payments to one regular payment. When I returned in January, I found an intent to repossess notice in my mail. I called and thought I had straightened out their mistake with regard to the application of my principal payment and the November and December payments. I confirmed that 5000.00 dollars had been applied to principal and the other payments credited correctly. Since that fateful phone call in January, I have been the victim of nothing but harassment from this company.

Although this account has never been in default or even late, I receive collections calls every hour on the hour at my house from 6:00 AM to 9:00 PM. I have spoken with the individuals calling several times and have been told, "I don't know why you are on our call list. I can see that your account is current. Let me talk to a supervisor about getting you removed." After waiting for upwards of ten minuets, I am then assured that I have been removed from their call list and will not be bothered anymore. During one of these numerous phone calls, I asked for confirmation of how my payments had been applied to this account. They were reviewed with me over the phone and everything appeared in order, so I erroneously believed this issue had been resolved.
Fast forward to the next day, still more phone calls. This has been going on for five months now.in February, I was so tied of their crap that I asked for a written record of all transactions on my account to confirm the information I had coincided with what they were telling me. Six weeks and two additional requests later after I finally got in the mail, I noted that they have not removed any of the late fees charged in error last year and in fact have added additional ones since. Their own document clearly shows my payment being applied to the account PRIOR to the due date and then a late fee added in the next entry. They also never applied my principal payment correctly.instead they applied part of the December payment to principal as well. Then charged me a late fee. I am sending them everything in writing from now on and all payments will sent via return receipt mail. I am also retaining an attorney to follow-up on the harassment and will be seeking compensation for my time in having to deal with this and damages for emotional distress.
