Lied about repairs and failed to make restitution to me, ripoff

Back in March I had some problems with my Mazda MPV, it was bucking when in drive and the service engine light came on. I took it to the local Mazda dealership... Which was Cox.

First they said that I needed a transmission flush, which they charged me for. But my car was still having problems. Then they said that I needed new spark plugs and coils. Which they ALSO charged me for. When I got my car back after they had changed the sparks, it was still bucking. Unfortunately that was on a Thursday at closing time. That Friday morning my transmission blew.

I had my car towed back to thier lot on Friday, and had to rent a car. My transmission was still covered under warranty at that time, so If they had properly notified my warranty company I would have been re-imbursed for the rental cost. I was told by Jason that he had called my transmission company but that they couldn't come out there for at least a week, and that because of the condition of my transmission it probably wouldn't be covered by warranty.

I decided to have my van towed out of there and brought to a transmission shop that had done excellent work for me before. When the owner of this shop called my warranty company he was told that he had NEVER recieved a call on that vehicle and also the adjuster was out there the NEXT DAY!

I called Cox up right away and spoke to Jason. I confronted him about this obvious discrepancy between stories. He swore up and down that he had called my warranty company. I asked him to explain then why my warranty company would say that they had never recieved a call on my vehicle AND that the man who supposedly couldn't come out for a week had showed up the next day.

Amazingly (and I'm being sarcastic here) Jason couldn't come up with an explanation for that. I went to the service manager Ben and said "Look, basically you've ripped me off for almost 500 dollars. You know it and I know it. Now you did a transmission flush, and you changed my sparks and coils, but that obviously wasn't the problem, and I KNOW that you know that wasn't the problem.

I'm not even asking for all my money back. I told them all I wanted back was the 100 dollar deductable that I had to pay for the sparks and coils and the re-imbursement for the rental car; since I was obviously out that money because they lied to me when they said they had placed a call.

Ben finally agreed to refund my 100 deductable to me. I said "well, I guess I'm going to have to turn around and use that money to file suit in small claims court." When Ben heard that he recinded on the verbal agreement to give me the refund.

I then contacted Gary Cox who is one of the owners. He handed the problem over to his second in comand who's name escapes me. Basically he offered to only refund the 100. I told him that because of Cox's actions I lost one of my jobs which brought in close to 20,000 a year becauase I had lost the use of a car.

I told him that I thought it was more then fair that I was only asking him for the 100 plus the money I was out for the rental instead of going after Cox in a larger court for costing me the use of a vehicle which resulted in the loss of one of my jobs. He did not see it that was and refused to send me a check for the 100 dollars because I refused to say that I would not take them to court.

Now a year later I find out that my sparks were never properly replaced, which means that EVERYTHING that they said they did to my car should be called into question.
