Claim still unpaid a month after insured driver's fault

I was in an accident with an ACCC insurance policy holder, and he was at fault.
Trying to get them to pay for my loss has been a nightmare. It is one thing after another. All I get is that they are waiting for more information about the incident, but I faxed the report. Their client got a ticket and a court date, so what else do they really need, other than to avoid paying? It has been a month and my car was adjusted two weeks ago, so what is their agenda?
