Ripoff Unfair Labor Practices

Recently my husband took a job at Medved AutoPlex he was told that he would make a certain amount of commission on all cars that he sold 30% commission and that there would also be incentives on top of that from the Manufacturers and that he would also receive a 50.00 Per car incentive if he sold 75 cars in 1 year and that he would also receive 50 bonus for Customer Satisfaction Cards. He was informed that even if he was the worst sales person on the force that he would be guaranteed to bring home 2500 - 3500 per month.

Well needless to say he is the top sales person for Medved in his first week he sold 5 cars in his second week 2 more in his third he hit the monthly goal set for him of 8 cars. All cars went to finance and everything looked good and then boom. All of the sudden the customers were coming back to pick up their cars and their down deposits and when my husband asked what happened he was told that the finance department called and either changed the price on the vehicle or wanted more money down. My husband brought home a wooping 605.00 his first 6 weeks. When we questioned the manager my husband was ignored, when he asked the General manager my husband was diverted back to his boss who again ignored him. After doing some checking into the wage laws for commissioned employees we found that he was entitled to minimum wage and that if his earning didn't equal minimum wage the difference was to be paid, when my husband went to his boss he was told that that would be a draw on his upcoming commissions, he said no according to the Wage and compensation order22 he was entitled to full wages. They found away around that and then informed him that he signed a document that stated he was an independent contractor. Well we did some checking and according to the IRS an independant contractor sets their rates and their own work pace and they are not to have taxes withheld from their checks and they are to receive an i-9 however Medved had him fill out all employee paperwork including a w-2 they are taking taxes out of his check with according to the IRS classifies him as an employee which then makes him eligible for the wage order 22, but his boss keeps telling him that this is not true. IT is against the law to be a 100% commissioned employee from what we understand but they just don't play fair.
