Collection Fraud Ripoff Posing as a legal firm illegal tactics Georgia

Fred Hanna & Associates have failed to uphold their portion of the verbal agreement we made over the telephone in late June to settle an outstanding debt they purchased from another collection agency. I have made multiple telephone calls to receive my settlement agreement, receipts of past payments, and a written guarantee to update my credit report after payments were complete. I have made over twelve calls to Fred Hanna and Associates in the last two months to Ms. Hall, Mr. Daniels and other representatives, however I have not yet received any written correspondence.

It is my belief that Fred Hanna has no intention of producing a settlement agreement to me nor do they intend to update my credit report upon full payment. I also believe that Ms. Hall lied when she told me Fred Hanna had mailed numerous letters attempting to collect on my old debt. I was instructed on Monday, August 23, from Ms. Hall that my settle agreement was mailed to my current address, but returned. She was not clear why my agreement was returned. Ms. Hall instructed me on Monday, to fax a letter of consent to Fred Hanna in order to receive a fax back with my settlement agreement.

Tuesday, August 24, Mr. Daniels told me that he could not fax my agreement until his manager approved the fax, but that the settle agreement should be faxed by close of business that day. No fax was ever received and I continued to call Fred Hanna and Associated throughout the rest of the week. He said that Fred Hanna needed a fax from me to consent to release the settlement. However, I had faxed my consent on Tuesday, August 24. I made at least six attempts to have my settlement agreement faxed to my on Friday, August 27, but the agreement was never faxed. My wife called Mr. Daniels on or near 4:00PM, August 27, to request he fax the settlement agreement, but he told her Fred Hanna and Associates had not received my consent to fax the settlement agreement.

All of my attempts during the past two months have not produced any correspondence through US Mail or fax. My attorney and I believe Fred Hanna and Associates have made multiple violations of the Fair Debt and Collections Act such as: threatening incarceration for outstanding debt, lying and misrepresenting Fred Hanna's intention to produce any written settlement agreement. Fred Hanna is rude and unprofessional and they rely on threatening tactics to defraud individuals.

I have no alternative, but to seek reimbursement for the payments I have previously made. To this end I have canceled payment for Check 180 to my account in the amount of $624.38. I have placed credit alerts with all credit bureaus. I have reported fraudulent activity to the Fort Worth Police Department (#04101181). I have instructed Bank of America not to pay any amount to said party due to fraudulent misrepresentation and agreed that any attempt to debit my account from said party will result in further fraudulent activity on said parties behalf. I am currently filing multiple complaints with the State Attorney General's Office, the Better Business Bureau and am working with my family attorney to file suit against Fred Hanna and Associates for fraudulent misrepresentation and violations of the Fair Debt and Collections Act.

I am giving Fred Hanna and Associates a suspense date of September 15 to refund my two payments in the amount of $1,248.76 and I will discontinue all efforts to file criminal charges, seek suit and drop complaints with all agencies against said party.
