Hello! Everyone: i just would like to leave you all with a quick update. I just received my ocwens motion for relief from automatic stay crap paperwork from trott & trott this week and what is so disturbing about it are the last 4 pages.
1. Of 5: assignment of mortgage from (mers) as nominee for ross mortgage corp. Our first closing motgage co. From 4. It successors and assigns (assignor) to Ocwen loan.
What i don't understand is Freddie Mac holds our note not this mers crap which we all know what is going on with that issue, but does'nt Ocwen have to get assignment from Freddie not mers because they hold the note now??? This just occured on january 25th after we reaffirmed in court thru our register of deeds???
2. Of 5: dated january 09 Mers paperwork showing the notary signature and witnesses of this paper from state of Florida of course, witnesses stamped names are unreadable and their signatures are not in full just chicken scratch then the notarys info. Is this normal???
3. Of 5: legal description of our property and tax parcel #
4. Of 5: NOW HERE'S THE KICKER!!! The copy of our note (2 pages) with blacked out areas made by a sharpie type permanent marker everything else seems normal on the page.
5. Of 5: the 2nd page of note at the end it states: witness the hand and seal of the undersigned: it shows where my husband signed but whats so funny whoever signed the paper signed his named incorrect and my signature is also forged and i never sign my name as it shows??? Then, it has an area where it states: without recourse pay to the order of:
Tebler, Bean, & Whitaker Mortgage Co. Typed it looks with a type writter from old days and noticed they spelled (Taylor) INCORRECT then it is scratched over with a pen and re-corrected by handwritting. At the bottom it states: WITHOUT RECOURSE PAY TO THE ORDER OF by: Taylor, Bean, & Whitaker Mortgage Co. (stamped) this time. At the far bottom right of page in (sign original only)!!!???
Well then!!! Who signed or forged our signatures let alone spelled them incorrectly??? I never would've signed it in 4 because our loan was strictly with ross at this time and as of 7 we received papers stating our loan was sold to taylor, bean & whitaker which only lasted 30 days before they were shut down and freddie mac took over loan and released it to cenlar, then a year later in 11 they sold it to ocwen. I'm very confused as to why ocwen isn't asking for release of note from freddie mac and going back to mers and why where our signatures forged and not made aware this was happening and why all these mistakes, typo's, scratch outs & black outs are on our so-called official copy of our note but not on ours???
Can anyone out there explain this to me because our local register ofdeeds office said this is normal!!! Really!!! Come on already...
