Overdraft protection fees - never signed up for service

Notice to TD Bank - SC 3/7

I am writing you today to document that I never signed up for over draft protection on my debit card; my wife and I have requested that this be removed from our account multiple times; I removed this protection from my online account on 3/5; I am requesting that you stop charging me overdraft fees; I am seeking reimbursement from TD Bank and I am trying to minimize my claim against TD Bank and;

I was informed today by J.T. Greene, associate Vice-President and store-manager of one's Woodruff Rd. Department, he mentioned our scenario along with you. He suggested that TD Bank’s placement was the $350 which was taken off our take into account facility protection since 5/2 wouldn't be delivered.

Mr. Greene mentioned the validation of the was that I'd been billed over $600 with Carolina First for over-draft safety annuallyapproximately ago and many additional costs with TD a couple of months before. I talked to my spouse and he or she stated she was conscious of these TD lender costs and directed a teller in the Woodruff Rd. Department, on a single evening of these costs, that she needed your over-draft support taken off our consideration. She also directed the teller that people didn't subscribe to this company. We obtained a notice from Carolina First / TD lender through your combination, declaring this support was on our bank card and we'd have to subscribe to it. I decided to not participate. I questioned Mr. Greene to analyze my consideration and confirm by my trademark and/or my wife’s trademark that people had registered for this support and because he couldn't create this paperwork; I'm in a reduction why you've upheld his choice.

Again, within an energy to reduce our shared expenses in this way, I'm seeking that over-draft safety costs billed by Carolina First and TD lender be repaid to the consideration by 4/6. I'm also seeking a combined sales declaration of over-draft costs billed by Carolina Initial and TD Bank from Jan. 1 March 6.

It's our good sense perception that immediately registering a person into an overdraft protection on the bank card is illegal and violates bank and usury laws. I'm not an attorney and that I don't understand without a doubt if your lender has this right or not. But I'm prepared to allow a judge determine if TD Bank has got the to cost people to get a support that TD Bank can’t show we decided to and also to decide if TD Bank has got the to proceed to cost people to get a support that people particularly required be eliminated.

Be encouraged - I'm attempting to reduce my state against TD Bank in SC and TD Bank N.A. The total of what we're requesting within this notice may be the return of funds obtained from our take into account over-draft safety from Jan. 1 2010 through March 6.inability to react written down by 4/6 will result in our pleading to the court for the return of monies removed from our account, reimbursement of court costs and legal fees, our lost time and productivity in pursuing this matter and any punitive damages that the regulation might permit. Any negotiation accomplished before going to judge might range from the return of funds taken off our consideration, compensation of appropriate costs and our lost-time and efficiency.

Also, inability to react in an acceptable method by 3/15 can lead to my processing a proper problem using the Federal Reserve, the SC Dept. Of Consumer Affairs as well as the Better Business Office.

By no means must something mentioned within this notice be interpreted to restrict some of my consumer-rights when I proceed to follow this issue; including any privileges I might need to produce public understanding of this bank exercise or any privileges I might need to combine the statements of additional customers having a related criticism.

Truly
