I purchased a forclosued modular home thru Conseco 4years ago in a moble home park. We are both very young and were 1st time home buyers. Well everyting went wrong the 1st day after the 1st month! The home had been damaged before the deal was sealed so they said they would make the repairs at no charge prior to us movimg in.
We had to wait 3 months and all that had been done was the carpet replaced. So we are finaly in our new home (3 months after signing) for about 4 weeks when we get a letter from the Park Manager (it states that a copy had been sent to conseco also) stating that the mobile home was 3months past due on lot rent and if not paid in 3 days the home would have to be moved. To make a long story short, Conseco didn't pay the lot rent for the months when the house was for sale so they were trying to get us to pay it.
Several calls put me tru to Barbra at the Kannesaw office. She promised to send out a check to pay for lot rent and get someone out to due the repairs, plus because she felt sooo bad she was going to fax over a statment to the park thaat they would cover all lot rent for the period of 3 months to make up for the stress we were put through. Okay, so up to the managers office I go to see the faxed agreement. It came tru, was signed by myself, park manager (Pam), and Barbra (Conseco rep). Everyting was great (except repairs still wasn't made) until the 3rd month of said agreement.
Pam called and said Barbra refused to send last payment. I called Barbra and she said " Hey, we paid your lot rent for 2 months plus the back owed for before you bought the place so be happy and start paying your own bills for a change, It's not our problem." So I paid the bill. Hey, why not. I was still happy with everything just didn't see why they were getting upset, I didn't ask them to pay it they offered it because they neglected to pay what they owed the park, which was going to place the home in the street if not paid.
Then 9-11 happened, by November both me and my husband had been laid-off and couldn't find decent job so we got behind on November payment. December 1st tru, we got 10x calls a day with Barbra asking for payment. I told her what had happened and she said borrow the money or it will go on your credit report, I pay $600 @mth and told her I could get half the payment for November $300 but that was it. New Years night at 10:25 we recieved a call from Conse. I couldn't understand anything he said so I hung up. Within 30seconds they call back but this time it's a diffrent person.
He starts telling me I had better get to wiring $1200.By midnight or I'd lose the house. He would't let me talk instead he said that because of dead beat losers like me he couln't spend new years with his family and hung up on me. The next day A women named Robrta called this is what she said." Hi I'm Roberta from the Atlanta moving company. I have an order to remove your trailor by 10am tommorrow, so you need to getout now or your stuff will go to!" I asked what the she was talking about and she said " I just have an order to move the home lady " and hung up. I called Atlanta Moving co and was told they had no order to move my home and no woman named Roberta, next I called the number on caller Id and it was a cell phone (no name).
Well the calls continued as did the rude comments 10x or more a day one even asked me to GIVE them my Parents Checking acconut number!!! When I called the Better Buis. They told me to keep a record of EVERYTHING and to start RECORDING the calls, numbers, mail post dates ect.
In Febuary Barbra calls again, we are now 3 months behind and she said they didn't credit the $300 payment because it wasn't a full payment but the check was deposited into their account.
It would be credited when we sent another 300. I had 1 week to come up with the full amount $2200. Or move out. I asked why it was so much and this is the way she explained it to me. $300 for Nov. $600 for Dec. $200 late fee for Dec And Nov., $900 for Jan. Because my intrest went up to 21percent intrect due to late fees and inability to pay on time. All this when I have a fixed intrest on my contract plus a fixed late fee payment of 10 percent of monthly payment or $15 whichever is less!!!
When I told her this and about how I have been keeping all letters, contracts, call logs (including messages from the untracable Roberta) she put her Manager on the line. He refused to give me his name (for my records) or to be recorded. He was very nice and seemed to understand my situation about, losing my job, repairs not being done (2 years after promised to get done by Barbra), increased fees, increaded intrest on a fixed intrest, rude calls, being asked for relatives checking account numbers and threts.
E said he was sorry and would file a complaint with the home office then started small talk, I was thinking finaly someone who will listen. While talking about family and children he suddently shouts YOU realy had me going didn't you I was going to give you an extention so you could keep your house but now I don't think I will! I talk to people like you alot at work you all are just to lasy to get off your a*es and find a F*ing job. I told him look I have everything on record and will find an attorny, don't call me, if you do you will be recorded weather you agree so go by the law and stop harrassn me!
He said " Where do you keep your records? Nevermind because missy those records don't mean damm thing! I want you to go right now and trow them out and I mean everything! They want help you when we go to court the judge will know your a liar and unresponsible. Hell, you are putting your kids out on the street because your to f* lasy to get a job. People like you don't need kids. Your just a stupid b*h and they will know. You have messed with the wrong guy this time honey so march your lasy a* to where you have your records and toss them in the garbage!!!"
Well at this point I was shaking, screaming at the guy and crying but I told him repeatedly that I was not going to trow ANYTHING away and that I would find out who Roberta was. He said" Be out of that house by noon tomarrow or I'll send the police to get you out because I'm signing the forclouser forms as we speak!"
The next day my mother and Bio-Father called me and said someone from Conseco called them that morning telling them their grandkids were going to be tossed on the streets if they didn't give their checking account number or a credit card number. Well my parents knew what was going on and gave them a few choice words. My mom said the problem was that now they were calling her house every 5 minutes and hanging up, the caller ID said Conseco at each call. My father was mad because he said they told him how much he made a month and that they new he could afford to get us caught up. He wanted to know how they new that. I have no clue, no one cosigned with us.
Robeta we have found out tru tracing the cell number and replaying the messages sounds alot like Barbra. I called the cell phone one late night and sure enough Barbra answered. We have moved out and told them they could keep the damn house I don't want it but I also don't want anyone else to have to go thru what we did. If you get an offer from them RUN. I do believe they are ran by the devil himself.
As far as BBB all they did was file a report. An Attorney said we could sue but they were going bankrupt and would not charge us anything so let it be a lesson and move on. Wouldn't get any money out of them. Als they sold our house to another couple for $50,000. We were buying it for $30,000. They said that the repairs still were not fixed and now their loan has been sold to another lender. They are much happier now.
As a last note, I have also found out that we were the 3rd couple to buy that home, the moble home was only 4 years old when we got it, all the previous owners had gone thru Conseco or Green Tree. Hmmmmmmmm
