Cimarron is a participant with Fannie Mae, Freddie Mac and FHA in the Home Affordable Modification Program (HAMP). Whcih is a lie, they did everthing in thier power not to do a affordable modification

Cimarron is a participant with Fannie Mae, Freddie Mac and FHA in the Home Affordable Modification Program (HAMP), this is a lie and at best misleading statement, I tried to work with them for a year and got nothing but roadblocks. Finally lost the house and after I lost the house they still wanted to take an insurance check from me. My advice stays away from this company if you do not want problem after problem. I found this company to be nothing but trouble to deal with and they do not care if you lose your home or not because they will get their money from Fannie Mae and Fannie Mae get their money from the tax payer.instead of working with me, they lost around $200,000 dollars of the tax payer money and losing more everyday on the house.

Here is what was wrong with the house and they still diid not want t work with me. 332 Westin Hills New Braunfels, Texas

Re: DENNIS RHEA Log Home New Braunsfel, Texas Foundation Inspection Dear

I first want to thank you for allowing us the opportunity to meet your client, Mr. Dennis Rhea. As you know, my husband Gordon, and I met with Dennis regarding concerns he has with the construction of his future log home's foundation. Gordon has built numerous log homes for my clients here in Texas, and has 30 years of construction jobsite supervisory experience in both the commercial and residential 'log home' industry. We first met Mr. Rhea at the entrance to his subdivision, so that he could lead us to his building location. Mr. Rhea (Dennis) informed us that he is very frustrated and unhappy with his current contractor. Dennis told us that he has concerns regarding his home's foundation, and questions whether it has been constructed properly. During our brief introduction and conversation, we learned that log stacking has not commenced and his log package has been sitting on the ground now for approximately 3 months. As you know, the desired timeframe to start stacking logs is as soon as off-loading of materials is completed. Although limited due to the way his materials were off-loaded (log bundles stacked upon each other; two bundles high), it did appear that the materials were protected and in good shape. To Mr. Rhea's credit, he has done a good job at protecting his Barna materials. The home's crawl-space foundation walls are constructed using concrete reinforced Styrofoam insulated panels, with a width of approximately 12" thick. Listed below, are items we consider to be constructed improperly or missing. 1. The piers constructed within the home's foundation appear to NOT be constructed properly. All piers appear to have been constructed too short, thus requiring additional 4x material purchased by homeowner to shore-up the main center support girder running the length of the home. (See picture). -continued next page-

Page -2- 09/02 Rhea Foundation Inspection Continued 2. All miscellaneous foundation piers were 'poured' on top of dirt grade with no excavation performed to reach soil rock or structurally suitable material. We literally could tip-over and/or move the individual piers. 3. Foundation pier at home's staircase location is MISSING. This pier is required to carry weight of interior wall gang-stud and second-floor girder support. 4. Both foundation piers required in Bedroom #2 WIC area, are NOT in correct position and NOT in alignment with each other as detailed in the Final Construction Drawings. These piers are required to carry the weight of the interior wall gang-studs which carry the weight of the second floor girder in this location. 5. The foundation piers required in the Dining / Kitchen Off-set area are NOT in proper location (both in relation to exterior foundation walls and placement within this off-set area). Piers are also NOT of proper height required to reach sub-floor girder in this area. 6. The four (04) piers required around the fireplace, as well as the fireplace footer are in the wrong position. 7. At ALL INTERIOR PIER locations no extra blocking between floor joists was installed. 8. The subfloor girder in the Dining / Kitchen location is flush, but without the necessary ledger or hangers for joists. 9. NO foundation wall or subfloor framing at location of walk-out bay window bump-outs at Dining/Kitchen & Master Bedroom. 10. The home's overall subfloor measures approximately " out of square. Crew needs to be informed prior to beginning of log stacking. 11. The location of the off-set for the home's Dining / Kitchen area is 2" off center of the house. 12. NO extra floor joists are installed at parallel interior wall locations, as noted and required on Barna plans. 13. NO extra blocking between floor joists at porch-post locations. Thank you again for the opportunity of assisting your client. Our invoice for this service is being provided separately. Please do not hesitate to contact us with any questions regarding this report. With my best regards Sincerely, LONE STAR LOG HOME, LLC Frances Scott
