Complaint / Review
America's Servicing Company
Wells-Fargo Bank "We want to help you keep your home"

After losing job June contacted mortgage co, explained circumstances. Associate advised that I should apply for the "new govt. Program". CSR also advised that acceptance was very strict and meeting deadlines would be critical. A packet of forms was forwarded to me. Deadline for return was June 26. A prepaid overnight envelope was included. Tracking confirmed their receipt of returned requested documents on 6/24.

Thus the battle begins. Daily computer generated phone calls, minutes to hours of being placed on hold for the next available advisor. No specific person to contact. Repeat submission of same documentation every 60 days. Written confirmation of unemployment benefits, letter of explanation of hardship and so-on. Finally given a person who is handling your account. Numerous voice mails left and no calls returned. The "next available representative" would mention my account's rep. And I would make a complaint of no update on my application "that would be documented in my file". Still more daily automated phone calls with reference to the fair trade..."you are being contacted in attempt to collect a debt. Any information obtained will be used for that purpose".

Another 60 day reenactment of the previous "assignment" and we are up to the holidays. My mother has a heart attack on Dec. 11th, and I am still talking with the mortgage company and trying to take care of Mom after her release from the hospital. I finally get the opportunity to talk with my account rep., Ms. A. Seil. She asks me what others have told me. I am then informed that I am not eligible for the "new govt. Program" because I am unemployed. Duh... That is why I am in this predicament. Sensing that she is clueless I asked for her supervisor. Not available-not surprised. That same afternoon I receive a phone call from Ms. Seil's assistant to inform me that my account had been turned over to another department and would no longer be Ms. Seil's responsibility but could not give me the name. This call seemed to be staged to get me off of her back. I finally talk with her supervisor with a few business "critiques" for him and am assured that he will personally follow up and contact me. "I'll hold my breath".

Another automated phone call, the unfortunate young lady (next available representative) states that while reviewing my account that I have been approved for the "forebearance" program and it looks like my payment amount would be $321.07. I was shocked. Finally. "Haven't you been notified?" I finally receive letter dated 12/31/10 stating that my payment would be $321.06 per month starting 2/01 -7/01/10. If become employed be sure to notify. There was no technical explanation of this program and when I questioned how this amount was calculated was told "looks like all you can afford". I made a full amount payment thinking that it would be applied as normal. It was applied as two forebearance payments, leaving unapplied money. I questioned this and was told, any changes to amount is applied as directed. Payments were made and received before the 1st. May 08 letter from mtg co states that I am delinquent $2002.81 and to avoid acceleration, must pay in CERTIFIED funds on or before 7/07.

Funny, all of the daily automated calls have ceased. When I received this letter, I called them. Read the letter of forebearance payment plan and representative placed me on hold to discuss this with his supervisor. I was instructed to keep making "forebearance" payments as letter states through July 1st.

The latest threat letter 06/05 states $2635.92 delinquent, pay on or before 08/04. Received letter dated 04/11 Notice of upcoming rate change on adjustable mortgage effective 06/01 $947/10. My weekly unemployment check is $239.00. I don't think that I have mentioned that I have a 2nd mortgage (originally through same company-has now been sold) in the amount of $207.61. Principal balance of $25,197.53. Principal balance of the 1st $107,484.47. Several foeclosures in the neighborhood. Wouldn't this make a great movie or play? Title me DUMB BLONDE.
