I started working with Wells Fargo in July on a modification of my home loan. My husband had left in August of and I lost my job in March. I was able to somewhat make it but knew that i needed help. I filled out the packet and faxed it in as told and waited not knowing to call and check on anything. I called in after finally recieving a letter offering short sale option. I was two payments behind at this time. I called and was informed that my property was in active foreclosure and I again asked about the modification.

I was given a lengthy list of things to fax and a fax number and told to call in two days to see if documents were received. I did this. I received another letter stating the request for preforclosure sale had been cancelled and the loss mitigation department had closed my file. From the letter received from them on October 7, letting me know they received documentation from me requesting mortgage assistance and another list of things to gather and a phone number to call to discuss my options they could help me with.

I did this and sat back and waited unknowingly. On Nov 8, received letter stating that in order for them to provide me with the results of their efforts they unfortunately, after carefullyreviewing the information I provided they were unable to adjust the terms of my loan as they cannot process a modification without input from me and they had been unable to reach me to discuss my situation. For that reason i had not been approved. I called freaking out because I also received a notice on my gate that there was a sale date of Jan 4th. 2011.

I called immediately and spoke to a representative who was very soothing and took my information over the phone to requalify me to be back in the modification program. This time it was different and I had to agree to pay 3000.00 by the 15th of November to ensure me every opportunity to retain my home. I saved that letter thank gosh. I did have to ask for an extention and they extended to 11/30/10. My mother seeing me struggle to find this kind of money just "laying" around, helped out and put up the whole amount so we could breathe for a minute. We were told to western union it to Wells Fargo mitigation dept and given a city code.

I did this and thank gosh again saved all of the receipts. I faxed more documents and called everyother day after that. Each time i call they ask 3 questions, Is this your primary residence, Do you currently reside there, Is it your intent to keep this property. I answered yes to all. My standard question was, is there a sale date and was told no there is no sale date. I did tell them about the notice I had received and I was told to disregaurd because only Wells Fargo can list a sale date and there was not one listed. The last contact I had with them was 12/30/10. They wanted proof of income I receive from the state.

I sent them the letter that states how much and for how long I will receive the TANF benefit. It doesn't show up as a bank deposit but it goes on my EBT card and I can withdraw it that way. She stated that the documentation had been received from the state to me letting me know what I would receive and for how long and that would be sufficient. She closed by letting me know she would be getting back to me in a couple of days to let me know the decision. This was a Thursday afternoon. I unfortunately was very sick and had several ER visits for respiratory problems, dehydration etc. And it was the holiday. I guess I should have been on my game a little better.

I came home from a Dr. Visit on Thursday the 6th of Jan. To a notice on my gate that my home was sold at auction on January 4. I freaked out. What had happened. I am still waiting for their decision. To this day February 2 I have not received written or any notification that my request for a modification was denied.in fact when I call they still ask me the same 3 questions, Is this my primary residence, do i currently reside there, is it my intent to keep the property. The only difference is I get an "oooohhh" the property has been sold, from the person on the other end and I have a list of names of all I have talked to, never the same one, no consistency.

Whose mistake is this. I was told that the banks are not Obligated to notify me of anything. Please tell me that this is a load of crap. The whole time I was asking for help I didn't know about the programs that were available. If they had utilized the Hardest Hit Fund at the very beginning and done it all right then this could all be avoided. I have become Ok with leaving my home, I am packing and storing because I dont want to be surprised. I had surgery for a hernia repair on January 19 and have been waiting for this for 3 months so I can return full time to work.

I have received notices to vacate twice. Once two days before surgery. And now there is a courtdate to forcibly remove me since i am uncooperative. How many people just get too scared to fight. I will store my belongings and secure a place for my four kids, but I will fight until I get some answers. I had a 15 year loan at 4.4% interest and all I wanted was to maybe extend it out to 20 or 25 year loan. With the programs offered 20 year loan at 2.3% interest who knows... Please get these theives and prevent others from this emotional h*ll.
