I would like people to know what this company has been doing to me as well.
My mortgage was initially with United COMPANIES FUNDING, when they folded it went to EMC. I have my home owners ins. With Foremost Ins. (a popular carrier for mobile homes). Each time i pay my insurance, it is usually right at the due date, not utilizing my grace period, but the insurance company autimatically sends out cancellation notices when your account is coming up due if they haven't receved your payment, when this happens EMC receives this notice and states they have a right to protect their interest, so they pay the balance of the premium, thus sending me notice they have paid it and i now owe them money. This has happened numerous times over the past few years!
I have sent proof everytime showing i have paid and have never had a lapse inmy policy since 1997. On one instance where this happened i told my insurance company to refund emc. They did, and now i have had to pay a lawyer to go to court because they now say somewhere i have not paid 4 house payments! So i researched my records and came up with the last year and a half of receipts, only to be told that wasn't good enough.
I needed all my receipts. For the past 7 years. For the past 2 years i have sent all my payments certified receipt mail so someone has to sign, i had all this info. Too. Not good enough. Now i have to pay double house payments and attorney fees for the next 6 months!
I am a single mom with 3 kids, if i don't do this we lose our home! As i said this has happened before. Since they constantly feel they should pay my insurance, they always have it as i am late so my credit is also going to be ruined, i am damned if i do and damned if i don't. Now the most recent thing is: yesterday in the mail i received a piece of mail from the emc office in california. It was a letter to me requesting i endorse a check from the insurance company so they could get the refund i ordered to be paid back, this would have been fine except i already did this in the last month and sent it fed ex, also enclosed was a check with someone else's name and the same letter with the peoples home address, insurance company, policy numbers for the loan with emc, as well as policy numbers to these peoples insurance company.
I am interested to know if my personal information has been sent to someone else before, as well as how many others are being bothered by this company? You may contact me via email
I am going to sit on this letter and check for a few days until i know legally what i can do and i am going to try and make contact with these people in chicago to see what they would like to do as well.
