We originally did a loan modification with Saxon Mortgage, but we first had to become 3 months behind on our loan (we were a week behind with our payments) so we had to ruin our credit to get the modification done. We enrolled and started their trial period of three months - we made every payment and made them on time. We were sucessful at getting a permanent modified loan - GREAT YOU SAY! We did too, thought it was all done and we we have since made every payment on time. The mortgage got sold to OcWen and we were immediately informed that we were a month behind on our mortgage. (Which we were not) We called Ocwen and explained to them that all payments were made and on time, we even sent bank statements, reciepts and confirmation numbers that we got from them. This went on every month - even after we were assured it was being taken care of. After 6 months we agained called Ocwen because they still claimed we were a month behind, my wife has spent untold hours on the phone with them to no avail, they then told us they needed a revolving bank statement from our bank as the bank statement and confirmation numbers and cancelled checks were not enough, our bank told us, we have never heard of a revolving bank statement before in our life and offered to again give us all statements pertaing to this matter. All this time we have been making our regular monthly payment - on time. We received 2 letters stating that we owed $ 2400.00 in late fees and penalties and the payment that is supossedly a month behind, we were sent to collections, reported delieqeunt to the credit bureau and their letter states we are in pre foreclosure status. My wife is very good at documenting every little thing and her records are pristine, we do not owe them - we are current and always have been. We will definetly win in court as we have all the proof to show that we are not behind nor have we ever been (until we get fed up and stop paying these rip-offs), Have spoken to a lawyer and he said he will take the case on - and blow them away. These guys are trying to foreclose on everyone as the loans are government backed - meaning if you have a modification and are foreclosed on - they collect from the government and get their money right away as opposed to 30 yrs. Of payments. I look forward to being rid of this company and cannot believe that after all the bail out crap - these guys are trying to rape the American people again.
