My father died in 1972 and at the time he had a life insurance policy with Metropolitan life Insurance Company. When my aunt, who was at the time the executrices of my father estate made the claim with Metlife they insisted there was no policy and did not pay out.
In 1975 when i got married I tried again with Metlife to make a claim and again they insisted there was no policy with my fathers name. Almost 30 years later I was on the
internet looking on the Unclaimed/Unbanded Property with the State Of New York and it had listed my fathers name date of birth date of death and a policy with metropolitan Life insurance.
I immediately made a claim and in October metlife sent me a check for almost $10,000.00 with no letter and how they came to the amount. Two weeks later after receiving the check I received a letter from Metlife insisting they made a terrible mistake that I was suppose to received $ 5,000.00 not $10,000.00 and that I need to send 1/2 the amount of the momey back. After receiving the letter i tried on several occasions to contact metlife by phone and by letter stating that i would like to see the policy, the amount of the policy, who the beneficiaries were and how they came to their calculations.
Three years went by and i have not received anything. All metlife could tell me that the policy was so old they could not locate it.in may i was served at work to appear in court for a pretrial hearing metlife is sueing me for $5,000.00 and if i didnt appear in court they would issue a judgement against me. I had to retain an attorney to represent me for $1,000.00 retainer. The pretrial hearing is set for 7/29/03. My attorny says if i win i can sue for legal fees.
