I bought my home in Oct. I had an ok job but it wasnt paying enough to satisfy all my financial needs. However, I did my best to always make sure that my payments went to my original loan/mortgage lender, Equifirst. For the first 3 to 6 months, things were tight but Ok.in March of I get a letter stating that my Mortgage was bought by another company, Wachovia, who then in turn, sent it to HomeQ Servicing. I got one behind in my payment by one week, and HomeQ Servicing sent me a letter stating that they sent my "loan" to the Modifications team. I tried repeatedly to contact them by phone, but kept getting the runaround, two more weeks went by, and I get another letter stating that I would be sent to Foreclosure unless I could get things caught up and pay late fees, service fees, etc.
By June I finally got a raise in pay, and I managed to get some extra money sent to HomeQ Servicing each month and for the following six months or more, I was able to pay everything back to the normal payments.in August of after paying everything that was owed, and sending each payment by wire transfer dutifly on or before the 15th of each month, I got laid off. This was an unexpected hardship. I called HomeQ Servicing and they told me that I would still have to pay the expected payment of $642.00 per month regardless of any hardship incurred. I looked for worked repeatedly for the following 3months, but couldn't find a decent job, so I had to file for Unemployment.
The Unemployment compensation was woefully inadequate for what I needed but it was at least something I could work with, so, I again kept making the payments, but by the time Dec rolled around, I was two months behind and struggling.in Jan of I get a letter from a branch office in Florida, that stated that my taxes had not been paid for 2007. My payments had somehow jumped up to $965.00 per month. My paperwork from that time showed that my payments were being handled by HomeQ Servicing which INCLUDED taxes and insurance. The office in Florida would not accept that explanation, and told me that I would have to come up with a full payment for back taxes or my house would be placed in Foreclosure; I recieved a letter from the local Sheriff's office and the county Tax Assessor stating the my house would be sold at Auction unless payment was made immediately.
I contacted HomeQ Servicing in California, and they told me that my house was already in Foreclosure and would be sold unless I paid them by wire transfere within ten days, the full amount owed. I contacted a local person here who is a mortgage arbritrator, and through him, we got HomeQ Servicing to back up on their claims, and I was able to get the Foreclosure stopped, and through a Modification process, got my payments lowered greatly, including the escrow for taxes and insurance payments included. Which still amounted to $642.00 per month. HomeQ Servicing asked for a one time payment of $1285.00, to start the modification, and stipulated that if I continued to make the $642.00 monthly payments for six months, I would then be locked into a 5yr payment plan that would stay at $642.00 @ 5.5% interest.
They asked me to fax the signed paper work to them in March. I did.in July, I get a letter that stated that they did not recieve the necessary faxed information, and that I needed to send it by FedEX, I sent the signed documents/agreement on July 28th, it was signed for by their own shipping/recieving dept on July 29th. From March to August I have made all six payments. Now here it is in Sept and I suddenly get a letter stating that they never recieved the signed for documents, So, I call HomeQ Servicing, and gave them the tracking#, and proved to them that they were sent and recieved back in July. They will NOT accept this proof. I called FedEX, and confirmed twice, that the documents were sent, and signed for at their offices. Despite this, I learned from HomeQ Servicing, that the payments which I've sent by Western Union moneygram, has never been applied to my account! Instead, they tell me that my payments are put in a "Suspended Status" Until the signed documents can be sent to them. Therefore, my account is now again in Foreclosure!
Through a series of stalling practices, and any action on their behalf being "put off" for a few more days, this causes their policy and proceedures of penalties etc etc to come into effect against me. I asked to speak to a supervisor, I was placed on hold for twenty minutes, then the line went dead. I called back and got someone else with whom I had to spend an hour with trying to re explain the situation; again during this time I again was put on hold or transferred and the call dropped. The last person I talked to would not give me their name, and was very rude, and threatened me with them hanging up since there "was nothing that they could do but document the call and let it go with that". Very Unprofessional.
I have documented proof of payments made in due time, I have documented proof that each payment included the required amount to satisfy the principle, taxes, and insurance for my house, But HomeQ Servicing WILL NOT look for, or consider any wrong doing on their part! I therefore have re enlisted the help of the local mortgage arbritrator, and have filed a complaint with the Federal Trade Commission. I would also consider joining anyone who has a ligitmate complaint to file a Class Action lawsuit against HomeQ Servicing, Wachovia, Barclay's Bank, and anyone associated with this whole enterprise. I'm seeking full damages, legal costs, and anything else that I can legally bind them to. They need to be held accountable and liable for their fraudulent practices.
