Countrywide, Bought my loan knowing that I would not be able to make the payments

We bought our house in May. Things were starting to look good for us, so we thought. Then about 4 months later we had a huge and I mean huge error in the checkbook. This error caused us to start getting behind in our house payments. We borrowed money from my parents to get caught up in the house payments. But that helped with the payments but not in our checkbook. We could not get ourselves caught up. This was the worse it has ever been.

We fell two more months behind and during mid December we received a letter from the mortgage co saying that we will be default as of Jan 16. I called Countrywide and asked for financial assistance. They asked me questions and said that someone will be contacting us in 5 days which no one ever did. I called back and they told me that it could take anywhere from 6 to 8 weeks to get an answer. I called back during that time and they still did not have an answer.

When I finally did get an answer they told me that we were denied because one of the companies or whoever deals with part of the contract does have that kind of program. Strike one! This was near the first week in March. I was also told that I should be receiving a letter of denial which I never received. The lady asked about trying to do a loan modification and she informed me that this was not a guarantee. I agreed and she proceeded to handle it.

I called Countrywide 4-5 days later and no one there showed any record of anyone handling it. I mind you that I have not sent any money yet because no one would give a definite answer. They checked around and could not locate the lady that I talked too. I gave them her name and ext# number. Still they could not locate her.

I called back about two days later and they said the same thing. I asked for a supervisor and he looked into it and found that she was from another state with the company. He sent her an email and she did not respond back to it by the end of day. I called back the next day and finally they got in touch with her. She called my house and gave me the same number as I was calling. I called back and told them what happened and they put me thru to a supervisor that I talked to before. He emailed her and she said that they are waiting for a supervisor's approval. That lasted til mid to end week of March.

I called back and another lady told me that it was denied. Strike two! The lady asked me if I wanted to try again but I said I would call back. I called back about three days later and the lady asked if I wanted try again. I told her yes. She updated my file and said I have to send a payment which I did. That was for April's payment. So I waited and waited.

I was informed later by mail who was my case worker. About one month later, I called back and they did not have an answer. I called back again two weeks later and did the same thing, no answer. I received a call about one week later saying that they needed me to call the case worker. I called and he was available and the guy that I talked to look at the file and said that he does not know why I was supposed to call. He looked at the file and said it takes time and to called back in 12 days.

Ok, we are now at three months. I still have not made any payments. I received a phone call from my new case worker and I told him that it has been three months since someone finally contacted me. He said that he apologizes for what happened and said that he wasn't going anywhere. He wanted to try and do this again. I feel that it seemed like the other modification attempt failed again or that no one was even working on it. He explained to me that there are two types of programs he has that could work for me. I told him that I would talk to my wife about it. He asked if he could call me back the next day and I said yes. Well he didn't.

The next day after that I received a letter from a lady in reference me filling out updates for my income and what is being paid out. If I understood the letter right, it was for a loan modification. I never agreed to it. I was planning on going the other way. I finally filled it out and faxed back on a Monday. He called the next day at my wife's work and said that he tried to call me, which he never did, and my wife said that she can't get these types of phone calls at her work.

When I got home I saw that he never called. Two days later I called and he wasn't around. I explained to guy why I was calling and he checked on my file and said that it was denied because I never told them what I wanted to do. He did call only once and that was my wife's work but never called me directly. Just because he couldn't talk to my wife he closes the case. Sure the call when they want there money but they don't call when you want them to help you. I told him that I faxed over the information and he "I'm sorry but there is nothing we can about. If you want you can start all over and see if you can try it again I said no!!! This sure did make me very upset. All this time and no one could or would do anything.

When I was 8 months behind, I received a letter from a lawyer about proceedings with foreclosure. I did not receive any letter from Countrywide about the foreclosure nor did I receive that first notice of denial back mid February. I was wondering if there is anything that can be done against Countrywide with what has happened with the house? I posted my issue on consumer complaints and I could not believe how many issues Countrywide has against them. They dragged me on and on which in turn I started falling further and further behind.

After the foreclosure letter from the lawyer, I called Countrywide to see if anything could be done. After a couple of days they finally wanted to help. They sent me a Home Saver Advance program that would help with splitting up what we owe over 180 months. All this is a loan and it is no way helping me out. I have not received anything from the program that states that we are in the program. I am so very upset with this company. I have been waiting since last December for help and this is what they do after the send me to foreclosure. Where was this program when I first asked for the help or even after the program started? I understand that the program started back in April or May. Why wasn't it given to me them when I wasn't that far behind? I want to make this company pay.

Countrywide bought my loan before I even made my first payment. My financial status has not changed since then and I am still not able to get a loan modification. Since it hasn't changed since I bought the house leads me to believe that they knew that I could not make the payments but still bought the loan anyways. Can anyone out there help us, legally?
