A sales rep for a company came to my home to sell me a merchant service agreement. He got my name from registration of my new business. I told hime my business was small (hot dog cart) and was not going ot be operating until Jan 15,06. He came to my home in Nov to present the product, a small credit card processing machine. He had me sign a paper he refered to as an order form that was not completely filed out. He said it was becasue it would save hime another trip to my house becasue it would be Christmas. He then mailed me a copy with entries added to the paper. As I read it I noted it was not an order form but a contract. The agreement was for them to take set amounts from my account each month. I called the rep protesting. I informed him that my business was not open yet and I was uncertain what my credit card processing needs would be. He reassured me that there would be no fees deducted until after Jan 15. I told him that I would need a wireless machine becasue I would be on the street away from electricity. He said I could return the machine if it did not meet my needs and he would resell it to another customer. I accepted the machine in Dec. Not realizing that they had already deducted over 200.00 from my account.
After two events I realized that the machine would not work without electricity and I sent it back to the rep by certified mail. I also sent him a strong letter about his deception and the charges that were now beginning to snowball from my account. None of the charges were consistant with the so-called contract so I considered the contract void. I encluded it in my letter. Multiple phone calls ensued from LFG who claimed that they are owed 4000, then 5000, now over 6000.00 form me for this little machine. I only answered them one time and refered them to their rep.
After over a year of harrassment they sent some guy to my house to have me "served" with a notice to appear in the civil court in New York City. I asked the guy for ID which he furnished. It said he worked for the Supreme Court of Texas (my state) and it had a phoney logo. I called the cops. He left his paper as trash in my yard. Now LFG has been sending repeated letters to stating that a judgment has been rendered against me for varying amounts and they claim that the amounts will continue to increase if I do not pay. I have checked the Civil Court of New York online and my name is not listed as a defendent nor is my business name listed. These letters are always signed be "the legal collections dept" of LFG. I have never recieved anything from the court or any legitimate service. On one occassion I received an identical letter which after openning I realized was addressed to a neighbor so I know this is widespread.
