Well heres part 2, in sept my case was dismissed, now gmac wants their attorny fees and they are taking me back to court, humm doesnt it make you wonder that a big corp like this has nothing better to do that try to get $12,500 from me, and by the way this is the same amount that they offered me to settle this case, but then they refused to settle the offer and took it back. So now they have hired another attorny one jeffery s lapin to represent them.
I have spoken to a new attorny since that last spineless one, he has told me that gmac is afraid of me why you ask well its because they know i can ask for my attornys fees since the foreclosure was dismissed by the courts 3 times, the real kicker here is that i have the disclosure evidence that their attorny michell mason aka david sterns office sumitted to the courts. This evicence clearly shows that they paid my insurance late, what this also provided me with is the fact that gmac sends out fraudulent info they send out account summeries with one date but their records show another
This evidence was shown to an investigator with the fla state attornys office and he stated to me this is clearly a case of fraud and is looking into it for me. Then theres the best part gmac sent in an agent one thomas moan, he is a performance review analyst for gmac, ok so he anwsered the interrogatory questions that my attorny asked. Question 4 was who was the insurance company at the time of the disagreement he anwsered citizen insurance corp, ladies and gentlemen the insurance company was a.S.I. This man clearly doesnt know jack and hes a performance rep for gmac??? The best part is he lied to the courts with this anwser as well as anwsering questions 6 and 8-9 with a lie this to is fraud and it also may be their undoing as i intend to tell the courts that gmac summited false info to them. And just so you know gmac sent in info showing the who what and when insurance policys were paid and quess what they forgot to black out the other peoples names, phone numbers etc,
I have been calling them, each one has told me that gmac is the worst one for paying insurance and that they paid their insurances late also (can you say repeated pattern) any of you classaction attornys reading this? Iam going to try and show you the actual evidence in gmacs own words
