Allowed ACH money transfers out of my checking account and are expecting me to be responsible

When I discovered fraudlent fund transfers from my business checking account, I immediately called Wells Fargo customer service. After 10 minutes on hold (after wading through a long series of voicemail choices) I was told to please hold again while my call was transferred to a different department. Then my call was dropped. This procedure was repeated many times until I had spent several hours on the phone.

I finally went in to my branch to file a claim, and spent over an hour and a half trying to get them to tell me what I needed to do to protect my account. The only suggestion they would make was for me to close the account and open another, as they told me my account had been compromised. They were unable to open a claim for me, or to download the forme necessary for opening a claim, but told me I just needed to wait until the claim forms arrived by mail.

I went home and a few days later I discovered 2 more fraudlent and unauthorized withdrawals from my account. I made multiple phone calls to their customer service and fraud investigation personel but was told over and over that i must wait for the forms to arrive by mail. Finally the forms arrived and I discovered i would need to have them notorized before mailing them back.

I called my brance and was feferred to a local Notary... Who informed me that Wells Fargo Bank had their own Notary in the branch. I called back and got the branch manager who made me an appointment to come in for assistance in filing the claim. The meeting took an hour and a half, included terminating my old account and opening a new one, and I had to order and pay for new checks.

I now have $100 worth of computer checks that are worthless. I tried and tried to have them put a block on my account or somehow stop the unauthorized transfer of my fuunds and they told me they were unable to do so. They also told me that, unless I reported the fraud within 24 hours they were not obligated to reimburse me. Since the missing funds took my account below the minimum balance I was now incurring monthly service fees and i was told that if the account became overdrawn they would certainly levy overdraft penalties.

They even told me that if "provisional funds" were put into my account to replace the missing money during their fraud investigation and those funds were not present at the end of the investigation, they would destroy my credit and turn my account over to a collection a collection agency.

Thank you SO much, Wells Fargo Bank. I gave you my money to guard. I pay you to guard it. When your security procedures are compromised you penalize and threaten me. TYou tell me MY account has been compromised... But it is Your system which has been penetrated, not mine. Someone hacked YOUR system to get my account info since I have not lost a check or a statement in the mail... EVER! I do not have home mail delivery, so all my mail is picked up and dropped off at the post office so no one has stolen my mail. I have never had a check go missing, every single one is accounted for. I have every monthly statement from the last 15 years and have never had one go missing. I do not give my account number over the internet or store it in my computer.

I am sure there is fine print somewhere blaming me for not checking my account online daily to search for fraud. I don't care about their fine print. What I care about is that their job is to protect my money. HA! What a joke. Their real job is to fee and fine me every possible time they can and to blame me whenever they fail to protect my interest. Their real job is to wear me out with soothing powerless customer service recordings, long holds on my phone inquries, and lots of call hangups. Their method is to get me so frustrated that I will give up.

I am filing in small claims court for each of the fraudulent withdrawals which they allowed. I am reporting them to every consumer advocate group I can find. I am terminating my accounts with them and telling everyone I know to do the same.
