The nightmare continues

Our nightmare began in November. We had built a home using a Countrywide construction loan. Countrywide misplaced $19,000 we paid in interest and have yet to provide an explanation or paperwork on where that payment went. We have a bank statement with prof they cashed our check.

Next, we converted over to a mortgage with them as planned. There were no issues with having the income to qualify.

In November, we had trouble paying our payment on time. My husband has been in real estate sales for over 17 years. Due to the Mortgage Crisis our income had drastically been reduced. We called Countrywide before the payment was due and asked if they could help. We have held a mortgage for over 20 years and it has NEVER been late. Countrywide told us that we would qualify for a modification aggreement and that we would be contacted by someone from the Mortgage Retention Department sometime the first week of January.

After hearing from no one, we began calling the number they provided. We were told that our case had not been assigned to anyone yet and not to worry. We were also told not to pay our regular mortgage payment due to the fact that it would delete the modification. We did not hear anymore until the end of February. We began calling again, only to be told the same thing. The first week in March, we received a notice of pending forclosure.

At this point we panicked and picked up the phone to try to reach SOMEONE with the authority to help. The delay in their response had caused our credit to go down the toilet. After not getting a response, we mailed registered letters to a number of executives in the Office of the President.

We received a call the next evening from our newly appointed Modification Officer. We provided Countrywide with the written information they were asking for, third time, and received a modification agreement in the mail. Our first payment was due July 1.

We had sent in a May payment which they could not locate as well as the $19,000 from our construction loan they still could not find. We were also sent a bill for 18,000 in fees that were never previously discussed.

After discussing this with the Modification officer the following week, she said they would locate the $19.000 and send us a New Modification agreement before August 1st. She also said that the payment we made in May went to FEES. We ask that she send us an itemized list of fees with prof of that in writing.

We are still waiting. We have spoken with Countrywide twice since to check on their progress. Each time they are polite, but indicate nothing has been resolved.

Help! Is their any place we can file a formal complaint? Are there any lawsuits being filed against them in the state of Virginia? Does anyone know how we can take further action?
