In January Toby Slusher (my mother) made me the sole beneficiary of her two accounts with AmTrust. On May 18, my mother passed away. On May 24, my sister, using a Power of Attorney closed out/changed the title on these accounts, without notifying the bank of my mother's death. Using a fraudulent document to obtain funds is a clear-cut violation of U.S.C. Section 18, #1344. However, AmTrust did not prosecute my sister.instead, they have sought to interplead with the courts to determine who the rightful owner of these funds is. This situation is absurd. AmTrust was negligent in verifying the validity of the Power of Attorney and was remiss in not fulfilling their fiduciary duty to their depositor. They view themselves as a victim of my sister's fraud — yet have done absolutely nothing about it. Furthermore, adding insult to injury, they expect me, the rightful owner, to pay all their attorney's and court fees.
