My saga began May. This 3rd party collection agency has passed off an "alleged" income execution to my employer. I state alleged because it was never actually filed in court only stamped received by sheriff office & the date. Not disputing the money owed, I began to make payments on a monthly basis.
The beginning balance of the amount owed & filed by Citibank (the original creditor) was $10286. For the last 2 1/2yrs monthly payments in the amount of $209 were being made to foster & garbus a.K.A. Forster & garbus.
Apparently after 2 1/2yrs of regular payments not being adequately applied to the account they issued an income execution to my employer to start garnishing my wages to pay off the balance of $13000 allegedly owed (which truth be told after making regular payments for 36 months the balance is now down to $5900). I can't believe that this is legal.
Within 3weeks of garnishing my wages I received a settlement letter stating I could stop all collection and pay off the $8000 owed? I would like to know if anyone else has what appears to be a non legitimate document that was served to them in the form of an income execution. I know I am not the only one dealing with these jokers from the previous reports I've read, but after seeing my attorney yesterday I can say I've done everything possible to rectify the situation and it is now in the courts hands.
