Today we got a summons from Marcadis and Associates, suing us for Bank of America. Both Bank of America and subsequent collection agencies, including Marcadis were given Cease and Desist orders and a Power of Attorney from the Debt Management Company we placed the deliquent account with. Phone calls persisted, letters were sent to us long after contact was made with the Debt management company and these creditors. We even received Threatening phone calls from the first Collection attorney that BOA had hired.
A trust was set up with the Debt management company in October of last year to negotiate and settle with this creditor or the creditor they represent. NO negotiation ever happened. Money is taken every month still from our account to pay into this trust.
Then today we get sued by this attorney who has been told on several occasions that the account was placed with the Debt Management company last year and they have power of attorney over it. NOw we are forced to get a local attorney and answer this summons so they don't just get a default judgement.
All this is what we tried to prevent and did the right thing by contacting credit counselors. They do nothing and with bankruptcy laws changed. Consumers are being scared, losing their property and their sanity and good name to greedy creditors. It's not fair. The amount now that is being asked for is over 2000.00 more than the account was last year when it was placed with the Credit counselors. They are asking for that amount, Court costs and attorney fees. I hope my Husband doesn't suffer another heart attack because of all the stress of all this.
