Mortgage origination: 4-1-99

We were sending $5 in addition to our monthly payment to start working on principal. Approximately 3 months after H&R Block purchased Option One, we started having problems (6-01). They placed that additional in a column that works against us & tacks on a $33 late fee interest. My wife & I are extremely busy people & by the time she caught it (3 months), it had snowballed. They could not answer questions pertaining to these discrepancies & had to "look into this & get back with us". Never happened. Later, anytime we asked again about discrepancies, they retaliated with demands for more money & when it will be sent. We met their demands. We never missed a payment. Before & about the time of the foreclosure (8-06), they held & did not "post" payments in a timely manner, making them late. This includes $3000 they sat on for
1 1/2 months. 8-06 we signed a forebearance agreement to make double payments for 10 months. We have met their demands on this signed agreement & finally have gotten a statement. 6 columns of numbers that you cannot make heads or tails of. We owe our $550 payment $425 "other" charges?
NOW IT GETS GOOD... 6 - PRESENT
2 months prior to the 8-06 foreclosure, we knew we were headed for big problems & started working with another mortgage broker to refinance. He pulled my credit report in early 7-06, no foreclosure was there. Late 7-06 he requested from Option One a buyout/payoff statement. They kept delaying this information for weeks. For reasons "beyond our understanding" Option One pulled/changed my credit report back from 4-06?! 8-06 there is a foreclosure on my credit report. Our attorney also requested the information & same runaround. Since this fell through, we signed & promptly paid/held our arrangement with a forebearance agreement
(8-11-06); 9-06 through 5-07; this was supposed to be until 6-07 (10 double payments) we only had to pay 9. WHY?

8-31-06 they sent me a SCRA form. I have not nor will ever be in the service, as they know in their records. I did not request, sign, or send this form in. Our attorney found that since 1-07 they have been servicing my mortgage/forebearance agreement under the SCRA form & were showing me on active duty through 2-08?! 4-24-07 they acknowledged their error, due to our attorney, & "will not seek to recover the undercharged interest".

5-12-07 through 7-07-07: They sent us 4 different payment amounts; (5-12=$550) (5-19=$613) (6-30=$550) (7-09=$975). We have been such delinquent borrowers that they have SENT us checks for: (4-11-07=$476 escrow refund) (4-14-07=$385 misc. Refund) (7-03-07=$1570 escrow refund). None have been cashed.

Our attorney has requested by; certified mail, fax, phone, regular mail; our ENTIRE payment history (4-99 through Present). Never happened. They WILL NOT release anything prior to 1-04 (4-99 through 12-03)?? They have had to have 3 separate signed documents faxed to them to direct all correspondence through our attorney, they do not. We have not received any statements from 7-06 through 6-07. We finally received one 7-09-07 stating we owe $550 payment $425 "other" charges & 6 columns of questionable numbers. This recent statement only shows the final 2 double payments; where & what have they done with the previous 7 double payments, & the first of 2 recent $550 payments??? 8 years & 2 months; (4-1-99 Original Mortgage=$52,720) as of (6-07 Balance=$49,798). We have paid $2,922 on principal with a 12.35% APR in 8yrs, 2mos. After 9 payments @ $1125.95=$10,133.55... Unbelievable!
