Mortgage ripoff Charged $395 Fraudulent Fee for Quote When We Told Them "Not Interested"

Similar to the other complaint, we asked Amerisave for a free mortgage quote and their loan advisor Chris Mullis took down our credit card number for identification purposes and for "future reference." When we told him we were not interested in their quote, he immediately charged our credit card $395.

When we first spoke to Chris, he assured us there would be no charge for the initial quote. We did not sign or apply for anything—all we did was to provide Chris some initial information over the phone.

We received an email on 3/9 from Chris with a quote; the quote was wrong—it was not for the type of mortgage we requested and the loan amount was incorrect. He was quoting an ARM mortgage, not fixed as we requested, for the wrong amount. My husband called him and told him immediately we were not interested in doing business with Amerisave. He did not tell my husband that he planned to charge us. The same day Amerisave billed our credit card $395!

My husband left numerous telephone messages between 3/10 and 4/5 for Chris telling him we were not interested and to please credit our card. He never called us backed us during this time period. On March 23, we received an email from Chris Mullis saying that our loan had entered processing! We never gave permission for this!

During the weeks when we were trying to reach Chris, we also left voice mail messages for various managers referred to us by the receptionist regarding our complaint and none of them called us back. It wasn't until today 4/6 that Chris picked up his phone directly. We were calling with our bank manager on the line to have the charge reversed. Chris told my husband he could not give us a credit and to leave a message with his manager, which we did. The manager still has not called us back.

We have requested that our bank reverse the charge to our credit card. We plan to contact their headquarters, the Better Business Bureau, and plan to contact other agencies that can prevent this type of fraudulent behavior from occuring again.
