History: Several years ago, following a divorce, I took out a small $300 credit card. I charged very little on it, and paid more than the minium when I did use it. Then the company slapped an "annual fee" on it, which threw it over its limit, then slapped an over the limit fee on that. I couldn't make that, so they slapped a late fee. It snow balled. I couldn't stop it until I got an IRS refund.By then, it was huge.
I sent them a huge check to cover it all and cut up the card. Time went by, I got another notice that the same thing was happening again. I called and asked them what was going on, they claimed they hadn't been told the account was closed. I was back on that same merry-go-round. When my IRS refund came in, I happened to be holding that check when the company called. I made an over-the-phone payment of over $1000 and told them to close the account.
I never heard from them again.
Then, suddenly, this year, I started getting notes from MCM. I don't have anything on credit, so I ignored them. Finally, I wrote and asked what they were asking me for money for. They sent me a notice that I owe them over $2,000 for this credit card account that they claim they bought from the other company. They also said they are "thinking about sending it to an attorney."
I sent them a $50 check and wrote a note saying that this account was charged off years ago, and that I will go through my records to find the proof, and that in the mean time I will make small payments to prove my good faith in working with them. However, I am living in terror. I don't take home $ and I don't have a savings account. I live in a house that is still half in my ex-husband's name, though supposedly I won it in the divorce. We never transferred it because I never could afford to refinance it. I own a car with a blue book value of $600. Even my furniture is on loan.
I don't think I can prove an over-the-phone check from years ago. I would be willing to repay this debt rather than be sued, but I honestly can't make huge payments.
Will they work with me? Do I have any chance of not losing what little I do own? I'm scared to death.
I can't do a bankruptcy. My ex spouse put us in bankruptcy years ago. It was charged off about six years ago, but I can't file again this soon.
