Collections Operations Harrassment and Unauthorized Debits, Ripoff Fountain Valley

Basically I have got pissed off enough to come out speak about my horrible experience with Cashcall. After doing some reading on the Fair Collections Act, I have found that Cashcall has been acting in a manner that I think is considered harassment. Let me note I have never been 30 days late, but they treat me as if they can't find me.

They call my references that I gave them which include family members to stir up things. On top of that they call me at least twice an hour for 6 to 8 hours a day at least between my work phone and cell phone. Ever hear of call and leave a message? Don't you think that would be considered harrassment? I'm sure I'm not the only one.

&Here's the one I am the most pissed off about

Another allegation I have against their company is the debiting they attempt on my bank account. If a debit doesn't go through, then they reschedule another debit for the Friday of that week. But when they reschedule a debit, they can't cancel it unless they have 7 days notice.

So even if you mess up the original payment and you contact them that day, they stop the next payment that will be debited. I think seven days is an unreasonable amount of time considering that I used to work at a bank and know that ACH payments can be cancelled up to 2pm of that business day. When the payment bounces, they take a $15 fee from you.

So basically, they pull more money out of you for being late even if you contact them that day of the shortage and tell them when you can pay. Furthermore, they'll send you a cheesy email the day before the withdrawl saying they are going to do the withdrawl. If you don't know something went wrong and you get that email, there's no way to stop it. Then you get hit with another bounce fee from your own bank plus their fee.

I am wondering if they really have the right to hit your account multiple times for that amount over the course of the month without a fair amount of time to warn you so that you can take measures to make sure money is there or cancel it so it doesn't bury you further with bounce tranasction fees and fees going to them. It seems unfair to me, especially someone who has been at the latest 20 days late. This happened to me more times than I care to remember.

I had been told by them when I got the loan that I had to do ACH payments. I was told several times that I couldn't cancel the ACH payments. I begged and a nice woman told me how to do it. Let's see if it actually happens. I still want to go after them for what they did on both. If you have something in common with these experiences, contact me as I want to take this to the next level.
