Ameriquest lied to me from day one (jason biggs) from the ann arbor office called me last year this time responding to my shopping for a mortgage online, my credit at the time wasnt that bad i was getting 6% all day long, i was in sort of a hurry cause i was behinde on my truck loan and wanted to pay it off along with other things and have lower payments and the ameriquest guy made me feel comfortable and assured me everything would be ok.
I still remember what he always said (no worries). And i put all my trust into him, he knew i was in a hurry and he knew my situation and he played it out slowly and smoothly.
He told me things would be wrapped up quick in about a week and that he could do a 60fixed (no worries) loren, call your truck lender and tell them youll be closing your loan in a few days. And not to make anymore payments on my exsisting mortgage, car loans credit cards... Everything will be ok (no worries).
And thats exactly what i did! And i waited-and waited!
I called to check on the loan and jason biggs was on vaction.
Someone else was handling my loan and told me they dont know if they could do it and i said thats obserd! Forget it ill call someone else, oh no mr vasquez were gonna do our best and take care of you, well get back to you soon. They did this for about a month and the truck loan company was looking for there money and i called ameriquest and said hey whats going on? And jason biggs was there. Anyways to make this part of the story short, they first lied to me about the time frame of the process of the loan and intrest rate, then delayed my loan to the end to the point i feared losing my truck cause i trusted this guy and he lied to me, so anyways oh no problem you been approved long time ago we just waiting for jason biggs. So now im dealing with some lady and she totally changed the loan proceeds payouts that i requested which didnt make any cents at all i think they did it on purpose, they took and paid everyone short leaving balances on everything leaving me holding the bag.
The whole purpose of the loan was to pay people off and get them out of my life and have lower bills and what ameriquest did was double my house payment and left balance so i still had 6months of all those high payments left to cover which caused me to fall behinde, but thats anthor story.
So eventually i fell behinde on ameriquest, but paid the other high creditors off so now i was only dealing with 3 payments, but was behinde with amc. So i remembered what jason said (no worries) call me in six months and ill refi you no problem so i go digging around in the paper work for ameriquest call him and hes no longer working there, they closed the whole branch office, i didnt even know so i call the main office number on the bill and they said they never heard of jason biggs.
And never had any employee named jason biggs so i say ok well jason told me i could refi after six months and the guy told me i had a three year prepayment penalty which i was sapose to have none, i spefically told him 30yr fx no prepay so now im pissed i start looking at the paper work and find out i have an arm.
So i write and call the presidents office and ask for copies of everything ive signed cause the stuff i had you can barely read it was copied poorly and presented that way by the mobil sighner which was also a scam, i was told that was being done at n/c to me and later find out i payd for it. So i receive documents that wasnt included in the copies i had given to me by the mobil sighner. So ok now im talking to amc and telling them ive been cheated, oh dont worry mr vasquez well give you a forbearnce to get caught up (had it in writing) paid my first installment of 2000.00 western union quick collect on the due date called in with the confirmation number and everything so now im trucking three weeks go by dont here from anyone swing by the house and in the mail box is a letter from western union that amc denied the funds (cash) folks. I call amc and they said my plan was canceled cause it wasnt enough money. The agreement was in writing i tell them, i asked who canceled the plan let me talk to them and nobody knows who canceled it, but was told dont worry fax the proff to us and well look into it and fix it.
I fax it and wait, a week goes by im out on the road swing by the house and there a note on the front door (foreclosure advertisement) of my home dated a week back and sale date of nov. 15 (three weeks)! I called amc, oh dont worry mr vasquez well work something out call us back we are still reviewing your fax you sent us (proof of the written forbearence agreement) and proof i paid to the terms on time per the agreement. So i wait! I called a few attorneys and they suggested i file chapter 13 imeadately, i say no i dont want to i just want to clear the matter up its a mistake, someones gonna correct it and asked them to call ameriquest, but the attorneys were not intrested for one reason or anthor, but they offered to file a chapter 13 that would remain on my record for ten years... I trusted the matter would be resolved. I call again, hey the dates getting closer please take me out of sale till you figure this thing out... I was told to send a hardship letter.
And i did, and it was honest hardship, they call me back and say we cant use this send us anthor on and i did, they call me back and demanded 10,000.00 to reinstate the loan and i asked please explain to me how you arrive at that figure and they told me thats what it is, i said ok send me reinstatement figures in writing and they said well get that out to you, but they never did. I told them thats impossible for me to come up with. At this time i asked them for a loan modification packet and they said they dont do them, but not to worry they are looking at my hardship, at this point i call there attorney and tell them what kinda run around im getting and they offered no solution to the problem or anything else for that matter and often never returned my calls... So finally i called amc again and ask for the modification packet and again im told they dont do them and i said thats bullshit. So finally im faxed a budget paper and told theres your mod. Packet, so i fill it out, im like ok between the good hardship letter i have and the budget ill prob. Get the modification right? WRONG! They left me hanging on it and was told it looks good they are concidering it loren and they could post pone the sale if its not reviewed in time before the sale. So i wait and i hear nothing, but other amc people calling me threating me to sell my home or they will foreclose on my whole life! And stated to me that they are really good at getting there money... Told me that they are going to sue me for a defencincy balance unless i did a deed in lue. I told them why would there be a def. Balance your appraiser apraised my property at 164k and your saying i owe you 154k which seems out of whack like a number they just grabbed out of the air.
Anyways come to find out the house isnt even worth that much they blew up the apraisel so they could squander my equity asset. Anyways closer and closer to sale i call and try to negociate with them and ask them to grant me a stay untill my question is raised way my wriiten forbeareance was breached by them and untill they completed reviewing my hardship and mod. Request. NO i was told, you need to sell your house!
I explained to them the house had been in my family for awhile and selling it isnt an option and i was told well we are going to sell it at auction for you. I called them attoenerys back and said hey, i dont want to, but lets file the chapter 13 and both attorneys said there wasnt enough time to do that i had to attended credit counseling... Thanks to bush!
So long story short i heard nothing from ameriqust about the mod. Or from there attorney untill the nite before the sale
Amc called me and wanted to give me names of there realestate people that would sell my house and i told them tomarrow your taking my house from me if you think im going to do your work and sell it for you after your apraiser over stated the value your sadly mistaken. Then at 9am day of sale amc attorney calls me and tells me i have six months to live in the house and i better keep insurance on it cause if anything happens to it im responsible... And gives me a number of a loan broker to call to refinance it and redeem it from ameriquest. I have never in my life experianced this much mistreatment and abuse in all my life like im not a person or have any rights at all they just did what they wanted to do and i feel like i got caught up in a trap with them and they took my house from me without tring to work anything out, and i feel really bad that i didnt file the chapter 13 when the lawyer brought it up, but i figured id do the right thing you know and work something out outside of bk. Im sure im forgetting something or things are out of order alittle bit, but you get the picture here.
In short they lied, cheated and swindled me out of my family home. Anyone that has an attorney i can join up with please contact me loren vasquez, if you call information i live in dowagiac, mi. And i need all the help and support i can get.
And please anybody reading my story if they are in any kind of postion to nail these fraudulant bastards please dont look away, it could be just as easy be your mother, grandmother, brother or sister that it happen too. ALLS I WANT IS A FAIR CHANCE TO GET MY HOUSE BACK!
