In November we filed bankruptcy. We owed CitiFinacial which was included in the bankruptcy.in November we received a discharge from the court. Shortly thereafter we started getting letters from Resurgent Capital Services.
One day I received a call from Daniel Coker he stated, "We owed them over $10,000" I told him I had never heard of Resurgent. Mr. Coker explained to me they had purchased our debt from CitiFinacial. I told Mr. Coker this debt was included in the bankruptcy and on our credit reports was written off as a bad debt. He told me he would check and get back to me. I never heard from him again.
We still got letters from Resurgent. We tried to refinance our house to pay off medical bills and this debt, but was denied due to Resurgent as a bad credit risk.
We made the loan with CitiFinacial February. Due to reasons beyond our control we filed for bankruptcy in November.in July according to the letters they must have purchased our bad debt, then after the bankruptcy was discharged in November we started receiving the mail with no explanation as to why or what.
Now they are threating to foreclose on the house. Can they do this as we signed no papers for this new loan?
