Posting payment incorrectly, false reported to credit bureau

I have had several instances where I really felt it was just poor customer service, and chalked it up to that until I started reading these other stories - and it just seems that the beginning of these other people stories is now turning to mine.

They posted my payment late even though it wasn't, and I just asked them to change it on their records and they said "it wasn't going to happen" even with my receipt. They reported this late payment to the credit bureau agency as late - as it wasn't. I do not receive any statements - haven't for months and now I know why.

We are getting ready to refinance and they know this and all within one week they started reporting the false information - dropping our credit rating and denying us the lower interest rate. We also need no or low doc loans, which is why we are with them. You call and they say we didn't report it, you are current, never late but they did report it after they were asked for payoff statement. THey assured me they fix the problem, but another month and they didn't - just this time they posted the payment late - no late charges assigned yet, and after asking them to correct the posted date in their system they refused, was very rude, and was hung up on.

They said what difference does it make, you weren't charged any late fees. But since I haven't received a statement in months, (I usually pay by phone) I am afraid this is going to become intentional.

And all this - before I started reading the RipOFf report. It seems as if this is the beginning for me -and if you take each incident individually, you could chalk it up to clerical errors and bad customer service.

However, there is just too much similiarities for this to be just coincidental, and I can not believe that this practice of theirs is not downright criminal. I have contacted our states Attorney General in hopes that they will look into this matter and I wont have to go through the horror some of these other went through. I have been paying every month and have never been in arrears but am afraid they will start applying late charges to those incorrectly posted payments - and since I haven't received a statement in months, I am afraid they are going to make it very difficult to refinance and ruin credit in the process.

I did however about a year ago receive a letter from a lawyer who does have a class action lawsuit against them but like an idiot and not knowing these problems (Oh and when I received the letter from the lawyer they were rated as B from BBB - now they are at a D) I threw away the letter. But they are obviously not afraid of civil lawsuits - they need criminal charges filed.

ANd don't they need licenses, why are they not being revoked. Will probably contact the California Attorney General as well. Please everyone contact your AG. I know companies make mistakes. I just aexpect a company to fix their mistakes when shown. This is just way too many reports of the same things that are ruining peoples lives to say anything other than these practices are anything other than company policy. And imagine how many people do not know about usacomplaints.com and are not making complaints.

If you are a customer - pay on time, keep track of everything, keep all receipts, and monitor your credit report - and do not assume that if you pay within the grace period that the payment is considered on time, according to them it is not - you just don't accrue late charges. Now what to do with this information I do not know, as they do not want to fix their "mistakes" - but it may help you later in court.
