Has anyone else had this problem.

Through our own stupidity, we had to file for chapter 13. We paid all debts IN FULL in only 2 years and a job loss and are well on our way to repairing our credit scores to over 700.

Four months after we were discharged, Countrywide started to send us letters saying we are a month behind and we owe late fees. I called them and they show all payments received after the bankruptcy was discharged. Confirmed every payment, date received, and the amount. Even sent me a transaction history showing a payment each month from when the court said I was to start making payments. But they said the bankruptcy didn't pay enough and that I owe them at least 1 month's payment. They acknowledge the order to adjust their books to make current but still say that I owe late fees and am still one month behind.

Now my mortgage adjusted and went down in amount. I paid the lower amount in March and April and they cashed the checks BUT they haven't posted the payments to my account. The people on the phone say acknowledge the receipt of the money but they are holding it until they have enough to pay the past due amount.

They now have slammed my credit by reporting I am 2 months late in paying my mortgage. I was trying to refinance but my banker backed out of the deal yesterday as my reprort dropped almost 100 points due to this past due status. Not only have they cost me money in interest i will have to pay in the future, they are charging me interest on over inflated balances due to Countrywide not applying the payments.

Has anyone else had this problem with Countrywide? I have retained an attorney and we will be speaking with Countrywide but I want some "case history" and precident set by Countrywide. I have a strong case but if there are others out there, I believe we can show malice and intent.
