This company tries to scam consumers by violating the Fair Credit Policy. My spouse (now deceased) and I had an account with Sears, due to my husband's medical problems we had financial difficulties, so I fell behind on my credit card payments, My fault I know, but the interest and the late charges piled up so fast and so hard that there was no way I could pay it, Sears wouldn't work with me even after I furnished financial statements to show I could only pay a certain amount per month, since I couldn't do the $250 per month they requested they turned the account over to an attorney,

Well so to say they got a judgement which became a judgement against my home, when I went to refinance my home I paid $1,000 towards my debt, unfortunatly I couldn't keep the other part of the arrangment to pay the other $1000 due to my being laid off of my job and due to financial reasons, after two years the attorney sold the account to Portfolio Recovery, in August I CALLED this company and told them I wanted to get the judgement removed from my home so I wanted to pay them, they offered me a settlement.

Which was $1,300 which paid the account and they sent me a letter stating my balance was zero.in November when I went to purchase a new home on my credit report it still showed I owed, the loan officer called them and they told him I still owed $786.40 which I in turn showed him proof of payment the cleared check, the letter stating the balance was paid. Which by the way was a good thing I kept all my paperwork, after paying like they requested which was in order to do the settlement it had to be a ACH from my checking account THAT DAY! Which was no problem but to stay after 90 days that I still owe them!!! I called and spoke to several people who stated it was their error that the account was paid and that my credit report would reflect the settled debt within 30 days.

So I let it go, in July THE NIGHTMARE CONTINUES ONCE AGAIN!!! I went to refinance my first home and Wells Fargo tells me that there is still a judgment on my home and they called Portfolio who told them I still owed $786 and unless it was paid they weren't doing anything! But yet they were paid in August. They never updated my credit report as they were supposed to do and yet trying to get my mortage company to pay them this amount that wasn't owed! Well after several phone calls and threatning them to either fix my credit report and to get the judgement lifted or I would seek legal counsel for causing me a hardship since I couldn't close on my home until this matter was squared away cause there was no way they were getting paid for an amount that was excluded from the settlement!

A represnative Latonya even told me that they made a mistake on my account and didn't clear out the $786.40 and that my account was paid, a Joe Jackson told my loan processor that I should just pay for it and get over it! He was rude and very unprofessional!
Well, after speaking to the manager and stating they were in violation of the FCAP sections 601 and 611 and that I will seek damages for the hardship they are causing they call and say that I would be recieving my letter of release within 7 days and than I would get a data source form showing they are updating my credit report!

This company has imcompetent people who are unfprofessional and do not adhere to the collections laws!
