Ripoff Keeping Storm Damage Insurance Money

On 03/09/06 my mobile home was damaged. Wind snapped trees and they fell into the kitchen, utiltiy room, and carport. The trees also fell on my car (while I and my 3 y/o were in it), and the trees fell on my husband as he was trying to get the baby out.

To make a long story short - the car was totaled, my husband 'just' had his leg broken (could had been worse), and well the house (kitchen part) had severe damage.

My individual insurance company (NOT GreenTree's) sent out an adjuster and by the end of the month I received a check from them for over $25,000. I had to endorse the check and then hand it over to GT. Since they are the mortgage company (owners of the home) they were going to put the money in escrow and when I got things fixed up and I sent them invoices for work done I would get that amount back.

I was told that if I didn't have the money to start repairs they would give me half of the insurance money.

I sent all paper work that they requested (copy of insurance summary on cost and also the contractors estimate and the endorsed check). Out of 25,000 plus dollars... They sent me 9,282.51. They said that was half.

When I got on the phone to the company (and every time one calls GT a new person helps you so you have to go through the whole story AGAIN), they stated with the Insurance estimate and the contractors estimate, they came up with only 18,565.02 total for repairs. I said but I sent you a check for 25,225.88.9,000 is NOT half.

One individual stated that who ever told me that I'd get half, they were telling me wrong. I said lady I have the paper work right in front of me and it says that I get half of the insurance money back if I cannot pay for materials out of my own pocket.

Then the statement was Well the contracter only gave us part of the estimate? I said What. I have that in front of me too. And from my calculations the estimate goes over the insurance check about 3,000$'s.

So the next statement goes as such, We pay for materials but not for labor. Once the job is done and you send us an invoice for the work done we'll pay for labor. Do you know how many contractors laughed at me when I told them that? GT said if I had a good contractor then he should know this is how the situation should be handled. My contractor stated he always works with insurance companies/mortgage companies and this is NOT how things should be going!

Once again... Long story short. GT still has my money and my home is FAR from fixed. I live in MO and it has been raining for the past week and I've got buckets on the back porch catching all the rain water POURING into the utility room.

So I've vented. I'm just wondering if there is anyone out there that thinks, believes, or knows if what they are doing is right!
