I signed in June with Ameriquest and like many of you, I did not read every single page and now I'm paying for it. The employment information as well as my occupation title and income information were all false, but I didn't realize this until recently when I heard on the news that AMC was under investigation by the FBI. I decided to take a look at my papers and quickly realized that I too had been misrepresented. I have sent all of my loan papers onto the FBI.
I tend to trust people and companies from the start and if I had only been more aware, I would not have signed a loan with this company and I would not have had to go through Bankruptcy (BK). My mortgage payment is huge for a single income family and last Summer, I finally decided that in order to keep going, I would need to file Chapter 7 BK to dicharge other debt and keep my home. While I was in BK, I was able to speak to a select department at AMC and although my contact never bothered to call me back or help me, a gentleman named Rudy was. That was until my BK was discharged and his department could not help me anymore.
Every month I call in to make my payment and every month I go through the same thing. The first 2 or 3 people will simply tell me that they can't help me and they hang up on me or they'll say their passing me to the "Home retention department" and I get disconnected. Recently I received two letters from AMC that my March payment had not been received and that if I didn't pay it, plus "reasonable attorney fees" of $733, my home would be in foreclosure. Yesterday I received two more of the same letters with another $733 added to it and it said that my April payment had not been recieved. First of all, I do make the occasional late payment, but my March payment was made and taken out of my account the day after I authorized it and the April payment, I mailed because I didn't feel like being upset by these incompetent people. That check did not go through my bank until May 2, which was after the 15 due date, but they have their money. Upon trying to pay my May payment, I get the usual, I can't help you with that ma'am and get hung up on routine. I resort back to my friends in the BK department where at first they can't help me until I stress that all I'm trying to do is make a payment. A gal named Laura finally helped me and the payment for May was made on time.
There are a few things that I'd like to hi-lite, first there are at least TWO helpful people in the company and I hope they go on to find employment with more reputable companies because they deserve it. But I've spoken with over 100 people at AMC and only two that were willing to help me and take my payment. This company obviously tries to wear people down so they can foreclose on their homes. They haven't got an egg to sit on in my case because the payments are there and have been received according to my bank and yet they continue to harass me about the payments and the "reasonable attorney fees" at $733 a month which may be construed by some as extortion since their atty (or whoever) is simply sending me a generic letter that they are sending out to people everyday by changing only the address and loan number.
I have an appt. With a lawyer this week and hopefully I will be able to dismiss this debt. I don't like being taken advantage of and I believe that I have been
