Please duly note Wachovia VisaBuxx Organization's willful breach of contract in regard to Section III. C by steadfastly refusing to issue the required PIN number for the Wachovia VisaBuxx card they issued my daughter Holly Dykstra. Furthermore, by issuing VisaBuxx cards in New York State, Wachovia VisaBuxx is subject to New York State General Business Law 349 which provides a private right to sue and provides for triple damages, minimum statutory damages as well as reasonable Attorney fees for those engaged in fraudulent and/or deceptive practices.
Case in point: Weeks after acquiring Wachovia's VisaBuxx card for the express purpose of enabling my 15 year-old to travel through Germany for over half a month with her High School German Club - with their express written agreement and multiple verbal reassurances from various Wachovia VisaBuxx representatives that my daughter would have full access to all European ATMs as needed - suffice it to say that my daughter and I have NOT yet received the much requested and desperately needed PIN number to even test the viability of Wachovia's ATM claims!
Consequently, my underage daughter is currently stuck in Europe with an entirely useless piece of Wachovia-stamped plastic and surviving on her own wits. Naturally, I have continued to phone and email the Wachovia VisaBuxx organization multiple times on a daily basis - an exercise in futility if ever there was one. They have consistently maintained "the PIN is in the mail" and have steadfastly refused to give my near-starving daughter the PIN number required to use her Wachovia VisaBuxx card.
In fact, the last Wachovia VisaBuxx representative I spoke with (named Doug at 1-888-738-1697) had the unmitigated gall to blame Wachovia's inability to provide the necessary PIN number over the phone - or by email - or by any overnight service and/or even U.S.P.S. Express mail (which I offered to pay any price for) - DUE TO THE PATRIOT ACT! This makes one wonder how the other (non-Wachovia) VisaBuxx cardholders traveling with my daughter managed to obtain their respective PIN numbers over the phone by other (non-Wachovia) banks just a few days prior to leaving.
Does this mean that Homeland Security should be notified because such great, good, common-sense, service-oriented banking is in direct violation of THE PATRIOT ACT?! Better yet, why is Wachovia making the same exact (albeit entirely fraudulent claim) in Section III. C. On my agreement with them: "obtain a PIN by calling us at 888-738-1697" and, by doing so, entering into an obviously fraudulent agreement? More importantly, why is Wachovia being allowed to perpetuate this extremely public deception in the State of New York?!
Parents, you would all be much better off giving your children hens' teeth to barter with whenever they travel as opposed to a Wachovia VisaBuxx card! Wachovia definitely gets an A for creative lying and passing the buck (to themselves) - and a big fat F - in regard to effort and virtually everything else. If "Caveat Emptor Awards" were given to the most heinous organizations on an annual basis - Wachovia would be able to boast the longest winning streak in the history of banking.in other words, if you've literally got money to burn - give it to Wachovia - who'll rid you of it quicker than you can flick a Bic lighter. Otherwise, avoid Wachovia like the plague to banking and human decency that they have proved themselves to be!
