Sears is suing me via JB&R for a debt that isn't even mine! I have requestsed proof numerous times, and told them if they give it, I'll pay it. Even gave written dispute as required by FDCPA, but they still refused. Also threatened garnishment and disclosed debt to a 3rd party. FDCPA violators!
They have lied when I filed report with Ohio AG's office. Think they're trying to scare me into paying. If they can't prove it, they can't collect it. But we go to court the 26th of April.
Don't think they'd be so dumb to have proof and refuse to give it, as I have proof I sent them a letter of dispute. Besides, the account went to collections in Jan. Or Feb. 1999 at the latest. The SOL in OH for credit cards is 4 yrs. Any help here or thoughts?
