Six weeks ago I got a letter from Boyajian, claiming I owed $175 in unpaid medical bills. I called the 800 number (on my cell, not my home phone) and got a very snide woman who kept interrupting me and asking "Would you like to pay that today? Would you like to clean up your credit by paying this today? Would you like to erase your guilty conscience by paying this today?" I asked for details on the supposed debt, and she rattled off some dates and times from 1998, when I lived in the state of Minnesota. I moved from Minnesota in and when I told her no one had contacted me in that two year period about any unpaid medical bills, she said "oh no sir, they've been trying to contact you. They just sold us the account last week and we're demanding payment from you."
When I mentioned to her that it was not on my credit report and asked how ethical it was for Boyajian to buy debts that were time-barred by state statute, she became very beligerent and said I would have to request info in writing on the debt. I hung up and typed them a letter, demanding
A) Proof that such a debt exists,
b) Proof that the original owner of the debt assigned it to Boyajian for collection,
c) Proof that Boyajian was licensed and bonded in my state to collect the debt
d) That they leave me alone in the event that they could not provide any of the above
Since sending the letter (by regular mail, not certified) I have yet to receive a response. They'll probably claim they never received it. Fortunately my home phone # is unlisted, and they have yet to call my cell (which I will swiftly put a stop to if it does happen). Unfortunately they haven't violated the FDCPA over the phone, but I'll be ready with a tape recorder if/when they do. Even if this debt is legit (and I'm not sure yet if it is or isn't because I haven't received any proof), I'm not inclined to pay something nearly 8 years old that should have been written off by the original creditors if it indeed existed. My credit record is spotless and these @$holes are not going to blemish it with some bogus charges. My mission in life will be to put these vermin out of business.
