To make a long story short 2003 I began having trouble with the mortgage servicer Fairbanks capital they alleged I missed three payments. I was immediately placed in foreclosure. Payments were refused. I attempted to make an equatable agreement yet ended accepting an agreement that only favored the servicer and mortgager.
When I could not possibly comply with the full terms of the agreement. Fairbanks refused to make any reasonable arrangement. I file a complaint with the FTC. Later I became part of the Fairbanks FTC HUD settlement agreement in which I was suppose to recieve monies overcharged and redress. Although the terms of the settlement agreement were afirmed on May 13.
Strangely on May 19 a construction company working adjacent to my property wether through intent or neglience caused the undermining of the buildings foundation further ran a catipilar into the structure of the building. I was forced out of my home of more then twenty years a lock placed on the door by construction workers. My valuable possession stolen.in essence left homeless with no where to go with my children a 6 an 12 year old and disabled commonlaw spouse. Because my mail delivery was stopped I was not aware of a foreclosure sale date and had to file an emergency stay with the bankruptcy court.
In the hope that all matters and issues would be clarified and resolved. Shortly during this time Fairbanks capital changed its name to SPS select Portfolio Servicers. I felt that because of Fairbanks capital impropriaties and actions the reason they where taken to court along the lines of those listed by FTC HUd settlement agreement. Although I am part of the agreement the inflated fees and escrow were indicative of insurance coverage futher the redress fund for harmed caused equal to cover mortgage and provide restitution to the property to a like new or make new condition the mortgager has been relentless in persuit to wrest title to the property and has attempted to sell the property on several ocassions.
I believe that all that has happen to me and my family hinges on the criminal yet faced with many adversities and no help from agencys put in place to help. It would smeen things are made to be covered up. I felt that the mortgage should have been suspended cancelled and underwritten and restitution made.
On one end I see my family was put in peril emotional duress our life interupted and uprooted. Where on the other end I see possible lost of property equity and future income. These should not happen in a democracy with a constitution and judicial process. Since 2004 I have been swamped with predators and opportunist with no real solution any positive asistance would be appreciated.
