This collection agency apparently bought a box of very old promissary notes from another agency. They sent me a letter in July stating I owed them $4141.10 for a student loan I obtained in 1985. I called them immediately to inform them I paid it in full with a refinance in 1995 including interest. I faxed the proof to them and they said they would look into it. A few weeks later, I get a second letter stating they are giving me one last opportunity to settle this debt and they are willing to accept 70% of amount if paid in thirty days.
I write a letter of dispute, giving them all of the facts and proof telling them I need a copy of the so called promissary note they have and give them a date which to send it to me. Of course, nothing. I call to find out status but just get a voice mail. No return calls. I get a 3rd letter today that they are going to refer my account to the attorney for legal action and lawsuit but they are willing to settle for now 50% if paid in 30 days!!! Can you belive these crooks! I believe I will be filing a lawsuit against them tomorrow for violation of Fair Debt Collection Practices. I have also filed a complaint with the Better Business Bureau of Florida, the Federal Trade Commission and the Attorney General for Florida. Nobody threatens me and I don't intend to let them get away with it.
