Ripoff employer, harrasment from branch mananger then fIred me while on vacation, her word against mine approved for fmla will not reinsate employment

I worked for the bank for year and a half when I was promoted to a new branch, which is Brownstown. The manager there practiced unethical behavior and when I said somthing to her, very professional and nicely, ever since that incident, I was harrased on my clothing, my work, although there was nothing wrong. She would schedule me days I would request off in advance.

Anyways, I was involved in a "serious car accident" and requested to take vacation asap on April 6 by word of mouth. I requested this to the assitant mananger at the time who held on to the planner which is where we wrote down our request. She stated that she would get back to me and she did, without the planner... She stated since we were short staffed and if I could take it the week of April 18. I said that was fine.

This branch is very disorganized and extremley busy with not enough employees... So one more than 10 occasions, we are not given weekly schedules untill we show up for work that monday. Sat 4/16/05 I was scheduled to work with this brand new assitant mananger and this point, there was no schedule given for monday.

However this time I felt as if it did not affect me, because I was already approved and on vacation starting that monday for 5 days. So I thought... The new assitant manager asked me if I could please come in ON MONDAY, because "the old assitant mananger" who was just demoted into a diffrent position in that same branch, was off on this piticular saturday and she thought she may have forgot about my vacation and she did not know who could open the branch MOnday.

I AGGREED to come in MOnday 4/18/05 and then was given a schedule in late afternoon, that did not have me on vacation. I immediatley went to her and asked, and told her this was approved and I only came in to help today. She said she would get back with me by the end of the day. However when i was finished with all my work at the end of the night. She was already gone. I then telephoned her and the branch vice president (mananger) two times at there homes that eveing.

I called into work on the Tuesday 4/19/05 and asked if the problem was fixed... And it wasnt so I said, so there would not be any problems (since I already mentioned the manager was harrasing me and diliberatley trying her best to fire me) I said I was using a sick day. So on Tuesday, 4/19/05 I continued to call the branch during the work day to speak to the manager but was put on hold for long periods of time (10 minutes. I knew the manager did this to others, customers so on, so I hung up. I then called my managers home and left a message and cell. She never returned any of my calls.

I then emailed her on Wed. 4/20/05 and asked her to contact me if I had to be in, since that week was my approved scheduled vacation and I already had previous appts. Set up, with my totaled vehicle from my previous accident and doctors appts. I asked her to simply write me back, other wise I would be taking the remainder of my days as vacation. Which would have been through 4/20/05 returning 4/28/05. She did however get the email as I recieved my reciept and I also called her and again was put on hold and later told she already left for the day. So I assumed since she never contacted me, I was on vacation untill 4/28/05.

Now this is this is it I was terminated by email on 4/25/05 by the branch manager for "voluntarily not comming to work" neddless to say zI have been fighting for my job back ever since. I have won the battle with unemployment, although they kept protesting my claim and I submitted all my proof and won. This is the twist, while on vacation I saw my doctor, in reguards to high blood pressure and stress induced from the work place and so on. He filled out the fmla paper work, that the bank offered me in July, yeah thats right!!!

Anyways, I recieved a letter from the bank on Aug 15 stating I was approved for fmla, not short term although from what the letter said, I should have been. They still stated I was not going to have my job back and that they cham=nged my termination date to May 6 although I did not recieve pay, I have not worked in that bank, since April 18 and once hr completed an investigation on my claim of wrongful termination and harrasment, etc. I recieved an email on May 6 from NCB saying that the investigation was complete and I will not be reinstated employment with them and they offered to change my termination code to somthing else???

This whole thing was so crooked. I declined and said I would be pursuing legal help. They will not answer any of my certified letters, questions, etc. PLease I need legal help from someone who can get paid, when I am paid, or probono. I do not have a job, denied 4 weeks of unemployment and now recieving but barely surviving. I can not afford high attorney fees. Any help or suggestions are welcome. Thanks!!!
