Ripoff BAD Servicing - They need to be stopped - need to refi Baltimore MD

The problems just keep coming with ASC. After reading this report, I know I'm not the only one!

In January 05 we refinanced our mortgage with H&R Block Mortgage, which at closing learned they operated as Option One. This company was questionable when it came down to closing, and there was a dispute regarding a payment sent that they said they didn't receive. I spoke with the rep there who verbally told me it was cleared up, and not to worry about it. Shortly after, we receive notice that our mortgage was sold to America's Servicing Company. Then we received a call saying that we were behind on our mortgage by 1 month, and I told them what Option One told me. They said I needed to call Option One to verify. I tried calling Option One but they didn't have our loan # in the system, and I couldn't get anywhere with them since the loan was sold. So I called ASC back and told I could pay them over the phone until I get proof from my bank, but they demanded 2 payments, which I couldn't do at that time. To make a long story short, we fell behind and quickly recieved a letter from them demanding $xxxx by 8/10/05 or they would initiate foreclosure.

So on 8/3 I sent overnight the exact amount certified that they requested to bring us current until Sept. 1. On 8/8 I called to make sure it was applied, and they hadn't received it. They said "will you have this to us by 8/19" and I told them that it was sent and is in their hands, so please check on it with someone. The rep asked again, I need to make an agreement with you that we will have it by 8/19 to prevent foreclosure documents from going out. I said I am not making any agreements with you, but you do have it and hopefully it will be applied by the 19th. He said he needs to note it in the system that it will be sent by the 19th. He also told me to call back tomorrow to see if they received it.

So I called back on 8/9 and it still was not applied. The rep asked me to fax over a copy of the delivery confirmation and I did. When I called on 8/10 it was applied FINALLY. However, they were still showing late fees of $400 in addition to what I had already sent. I called back and they said that I incurred another late fee by sending it in August (then why wasn't it on the amount they gave me in the letter to have to them by the Aug. 10th?). But she said that some $ was in suspense, so the late fee is actually only $200. I asked if a new statement was to be sent with all of the payments applied, and amount owed, and she said yes.

Yesterday in the mail I received my Sept. Statement and payments were applied, but the late fee was more than what she said. So I called ASC and in the message they reported yet a different amount than what the statement says, and different than what she told me. When I tried reaching a live operator, the message said that no one was available to take my call and hung up. IT'S AMAZING HOW WHEN YOU ARE LATE ON A PAYMENT, THEY ARE THERE UNTIL 10PM!!!

Then to top everything off, I also received a separate letter from them saying that on 8/8 I entered into a forbearance agreement with them and that I am to pay the original amount owed by 8/19 (with extra amounts added) and my Sept. Payment by 9/15 at a higher amount (which technically would fall within the grace period, so a late fee wouldn't apply). They also said that payments need to be sent to Ft. Mill SOUTH CAROLINA! How confusing! So do I send my Sept. Payment to the statement address in Maryland, or South Carolina? And no one "live" will take my call!!!

I am so scared to deal with this company. They need to be investigated, and I need to find another company to refinance with. However, now that they've noted on my credit report that I am in forbearance with them, no one will probably touch me. And I never agreed to a forbearance! It's not my fault that it took them almost 1 week to apply a certified check that was overnighted!

Any advice would be appreciated. I need to find a new mortgage servicer and/or attorney.
