Fairbanks Capital Now Knowns As Select Portfolio Servicing ripoff

Our Problems began in 2001 in April, which was 3 mos. After we paid our first payment. The history of forced insurance payments, late fees that came from I don't know where, charges for someperson to drive by my house and take pictures to make sure the house is still where it is suppose to be, plus all the things that anyone can think of are just the beginning of the harrassement we are facing.

The foreclosure hearing was a few days ago and I really learned some things. Here we go with a whole arsenal of paper to prove our point that we had paid our payments and that they were on time, and that we did have insurance on our home. The thought crossed my mind as we were driving to the court house that our Madam Clerk of Superior been in office a short time, How could she know about foreclosure laws. Needless to say she didn't have to know, all she had to do was ear us say that yes we were behind on our payments (it didn't matter that SPS wouldn't accept them and the last 3 I had made were sent back to me by Western Union) and the foreclosure is proceeding. The hearing was over almost before it got started. So much for self esteem.

A few weeks ago SPS hired and attorney from Charlotte and they proceeded with foreclosure.By the time the court date was set, I had received no less than 6 letters from them plus the Sherriff has served the same papers for foreclosure. The same day of the hearing at 9 pm in the evening SPS was calling me to see if I would work out something. I have been offered so many plans by them to catch up my late payments (as they refer to them), but never a remedy to all the extra money I will have to come up with and never a promise to fix my credit, and never a promise as to when the nightmare will end. I have called HUD Inspector General Hotline, I have notified my senator, I have filed still another complaint with FTC, Hud National Servicing Center, NC Homeownership Center, Loss Mitigation, Hud Consumer Counseling, the attorney's office that represents SPS. Between Fairbanks and SPS I have talked to Chad Halverson, Micheal Montague, Julian (Employee #9347, TR Dowell, Heidi York, Russ, and some person at Gilardi & Co.in California that was handling the redress fund for the class action suite. I have gotten no help yet. I did get a letter notifying me of the class action suite and that Fairbanks had illegally charged me $1802.07 and that I needed to sign the claim form and send it in to Gilardi, which I did. They say they never received it and I wouldn't have gotten that much anyway. But Neither would i see any money.

I talked to the attorney that closed on our house. He sent me to a bankruptcy attorney, but also he didn't believe a word I said and in fact told me that he was getting very exasperated with me as if all the things I was telling him was fictitious.

Anyway I guess the story will end on March 3 when our house goes up for sale. And after I had the hearing in the clerk's office I have received 2 more letters that keep telling that the sale of my house is Mar. 3, as if I didn't know. As of this writing on Feb. 18 I got another call from SPS today they are still trying to see if I will agree to all these excess fees that they added to my mortgage. I had already ordered one history of my payments to find where my money went, when I tried to tell him what it said, he said he couldn't understand what all the figures and abbreviations were and that he would order me another type of history that would be much easier to read.By the time I get it I won't have a house. Any of this sound familiar???
