Harrasing tactics, invasion of privacy of innocent third parties, innuendo of criminal conspiracy with innocent third parties, threats to garnish 75% of wages: If payments of $1000.00 per month (53% of take-home wages) is not agreed to.intidimidating, humiliating and threatening language.

On January 18 I received a phone call from a rude and abusive Mike Daniels who mentioned my ex-wifes name and demanded my birth date before he would tell me what his call was about.

Thinking something had happened to one of my children, I relented. Then he went on about my "frequent contacts" with my ex-wife in this matter. I told him 3 times that I have not had any contact with my ex-wife since November, 1997 in court. He called me a liar.

He insisted that I was lying about not having "frequent contacts" with my ex-wife, And emphatically stated that I had contact with my ex-wife in April because he has her "phone records" and bank statements. His tone and innuendo was that my ex-wife and I are co-conspirators in some sort of improper behaviour about this matter.

I have court certified legal proof that my ex-wife and I have had no contact since November 1997. She has no knowledge about my situation and is not a part of my problems with these predators.

I was seperated from my ex-wife for almost a full year when I opened this account. She had no prior knowledge about this account, or any of my other dealings since our seperation.

It is obvious that Mike Daniels violated her rights by investigating her in this matter. It is also obvious that Mike Daniels is intent on slandering my ex-wife in this matter. At this point in our conversation I still did not know what he was talking about.

I finally asked him what this call was about. He said I had an unpaid balance of $13,000.00usd with Providian National Bank. The only truth I got from him was that over 90% of this ammount was all interest and late fees.

The policy of First Resolution Management Corporation (a collection agency frequently used by Providian National Bank) is to use unethical and illegal means to collect debts, which include investigating and slandering innocent third parties, besides unethical and unprofessional behaviour.

If you're po'd about your victimization at the hands of the unscruplious collection agencies that Providian National Bank uses: you can call Mike Daniels at 1-888-663-1717 ext 186238 and give him a piece of your mind.

In January, 1997; as a recently seperated man, I was forced by threat of death to leave a good job and settle in another state with my 3 abused children (my ex-wife as the abuser). I had $38.00 when I resettled. We spent the first 3 days in a homeless shelter untill a good Samaritin befriended us untill I could find a job.

My new job only payed $19,000.00 in my first year. My credit was ruined by my vengeful ex-wife. The IRS has garnished my wages for back taxes ($13,000) and penalties because my ex-wife refused to file jointly. They won't be paid off untill some time next year.

Mike Daniels "ordered" me to default all of my other obligations and move into a homeless shelter so I could pay him first! Because my situation is so tight, I have no disposable income left after I pay the obligations I am paying on now, so he offered the "solution" I just mentioned.

In 1998 I had a companion move in with me, and I aquired a few credit cards in an attempt to re-establish my good standing. 2 of those cards were from Providian national Bank at 24% APR. I accepted the usurous interest rates as a fact of life when dealing with "Legalized Predators".

In 2000 my companion got sick and we lost the one third of our income which we had depended on.in 2002 my companion died of liver cancer.

I was just barely getting by and paying mostly just the minimum payments on my credit card debt after we lost that income. Then: I received my monthly statement from Providian National Bank with a 30% APR (with no prior warning the interest was to rise)

They already knew about my situation when they did this. They also were aware of what the consequences to me would be. I believe it was because of a political view I expressed to a manager when I was trying to get a short break untill I could get back on my feet again.

That rise in interest made it impossible to make the minimum payments. I informed them of this when I closed the account. They were totally inflexable. I paid what I could for a few payments and watched the balance rise by more than my payments (my minimun was $260 a month) I could only pay $200.00 a month.

When their inflexability became overbearing: I stopped paying in hopes of forcing a deal I could handle and honor.in my first contact by phone they "considered" my offer of $200.00 a month and asked for a "Fee" of $250.00 to set it up. The next payment coupon came with the same balance and the 30% interest rate plus late penalties demanding somewhere around $500.00 to bring the account "up-to-date".

I stopped paying again. They made an offer of a 10% interest rate where I agreed to Pay another $268.00 "fee" and make the 3% minimum payments. My next statement was still at 30% demanding something over $800.00 to bring the account "current". They lied again. So I stopped paying again.

I received a letter explaining that my second account with an $1,800.00 balance would go up to 30% if I did not close the account or pay it off in full within 30 days. I promptly closed the account.

The interest rate went up to 30% anyway. So I stopped paying on that one also. As this was going on I began making higher payments on my other debts so I could get into a better position and find an attorney help me work out an equitable arrangement with Providian National Bank because they are liars who reneig on ALL arrangements made by phone.

I bring home $1900.00 a month. My income is fixed. I have not had a raise in 4 years, and don't expect any further raises untill the business I work for re-stabilizes.

My household expenses (including transportation by a 20 year old car) is $1347.00 a month, of which $592.00 is medical expenses because I am diabetic and my wife is disabled.

With what's left I have to juggle around to make payments on my other credit card debt and unpaid medical bills, plus buy groceries. These debts and what I still owe the IRS totals out to $5,300.00 as of this writing, which had been over $15,000 about 2 years ago.

If you have a Providian credit card: Close the account now and find a reputable credit counselling service who can cut your interest rate in half (or better). Providian and First Resolution Management Corporation are proven abusive predators and liars. They will not work with you when you try to handle the situation on your own.

When they reminded me of the "fine print" I quieried them by asking "the print you need a microscope and a lawyer to understand?". He said: "Why don't you buy a microscope?"

Since I can't afford a microscope: I'm "up the creek".

If anyone bought a microscope and read the "fine print" they would not agree to their hidden terms.

Basically: since being told to "Buy a microscope" indicates to this writer that: a "legalized" conspiracy to defraud the consumer is the intent of Providian National Bank and their use of abusive and unethical collection agencies is further proof of a totally unethical business model.

Providian will not work with you when you fall on hard times. My other creditors, including Capital One Bank worked with me and accepted less than the minimum payments and waived all late charges. Those accounts were brought up-to-date within 3 months.

Providian told me not to pay my other creditors so I could pay them first. You can not deal with Providian National Bank or their collection agency known as "First Resolution Management Corporation".

First Resolution Management will drag innocent third parties into your case and slander them by innuendo and guilt by association. Though they have not harrassed my ex-wife yet: I expect they will when they get wind of this post.

First Resolution Management violates the right of privacy of innocent third parties by investigating them without probable cause or the legal right to do so.

Do not make any phone deals with First Resolution Management or Providian National Bank. They are all proven liars who will attempt to put you into impossible financial distress by demanding they be first in line with payments so high, you would have to go hungry. Do not cave in to these predators.

If they continue their harrassing tactics like calling you at 3:00am or constantly, several times a day or harrass your employer (they harrassed my employer on one occasion and called him a "deadbeat"). Tell them to never call you again.By law: all calls must cease.
