EMC Mortgage purchased my mortgage from Aames Funding in Jan (without our knowledge) since we was about to go to court against Aames.
We found out who had loan and contact them by mid-Feb and I thought we was working out a payment plan in the Loss Mitigation depart.in the mean time the Foreclosure office started the paper work - we wasn't notify until 5 days before the sell.
We did get a lawyer again since we knew we wasn't at fault.in the meantime EMC is asking for $290,000 for pay-off the list of fees is overwhelming they have change payment, rates, points, added insurance, taxes, and escrow account fees. Those we never asked for or sign for - we pay our own.!!! And a note they paid $197,000.
So EMC can collect on all the so called fees after a foreclosure if your home didn't sell for what they are asking - within one year they can still come after you for the amount owned.
We cant even get a new loan with a good company, both Aames and EMC has manipulate our credit scores.
It seems to us that the law is for the unfair practice of lending with American Corporation and not for the consumer who is being punished for trying to make house payments and was refused and after signing the note they went in a change everything to benefit the company, not leaving the closing papers, threaten phone calls, mail and having a person come our home.
We can give you a list of things that both companies have done wrong but in the eyes of the law if we couldn't come up with 50,000 to EMC we had no case
