Settlement Papers Require Releasing Driver Found Guilty in Court

UPDATE: On 5/27 I filed a complaint regarding Allstate and its representatives: the company's attorney, three adjusters and the CEO, who gets $9 million per year.

Since then, Allstate's representatives have attempted to manipulate me into signing false statements which would discredit me. See the following.

My attorney suggested that I "settle or dismiss," which left me with the impression that I should not expect anything better. I begrudgingly told him to settle. $8,000 is NOT sufficient; it covers nothing after my attorney gets his fees. I then received two documents that I am expected to sign in order to receive the settlement:

1) An INDEMNIFICATION AGREEMENT. I am expected to "hold harmless" and "indemnify" Allstate AND the driver who was found guilty in City of Atlanta Municipal Court on 12/09.

2) A RELEASE OF ALL CLAIMS. They want me to sign a document that states that I was not "induced" by "representations" made by my attorney and physicians regarding any aspect of my case. It goes on to state that "the parties hereby released admit no liability" and that the settlement "is made to terminate further controversy."

These conditions were NEVER mentioned before or at the time I was advised to settle, and these documents were NEVER made available until afterward. Had I been made aware of these things beforehand, I would NEVER have agreed to anything.

"Admit no liability?" The other driver was found guilty in court. Now they want me to sign a statement that says the driver is not liable. Furthermore, they are supposed to be compensating me for damages, not just "terminating controversy."

In the beginning I had no plans to sue the driver, because I (mistakenly) thought that her insurance company would do what she paid them to do. Now I have no choice. They are forcing me to sue their customer.
