Concord, David Kinard And President Chuck Nance An absolute nightmare! Beware of Chuck Nance, Kis Golf, et al!

What a nightmare! My wife was duped into visiting the Kis facility at Concord Mills by a friend. She ended up signing us up for a membership. This was on Dec 30. She told me about it that evening. Seiing the amount of $5515 and no way to pay it, I was unwilling to be committed ot such a mistake. I tried contacting the store the very next morning, only to be told that the manager/owner was not available. I was given his email address.

I emailed him telling him to cancel the application for membership immediately and not to order any "custom fitted" golf clubs. My wife has never played golf and cannot even consistently strike a ball. How you fit someone who cannot hit a ball is beyound me. Anyway, I received a reply late in the day from Mr. Kinard indicating that he would only communicate with my wife. My wife did not want to communicate with him and I told him that he would need to communicate with me. I told hime that my wife did not earn the requisite $40K per year that they required and that I was not willing to pledge any of my earnings for this membership. We simply did not want it. Stop everything.

Well, then I got an email from the so-called president of KiS Golf, informing me that, among other things, " Emails like the one you sent will only ake things worse for you." (This is copied and pasted from his reply exactly as written)

I had several more email exchanges with him. He is the rudest, most unprofessional excuse for a company president/spokesman that I have ever encountered. His tactics are to threaten and bully. Other excerpts from his emails: "We have never lost a legal case when it has gone that far. I will find out if the clubs have been made if they havnt we should be ok. If the have they will be paid for, period!" "Mr. Nagle, please feel free to call my office within regular working hours and I will be happy to discuss this with you. No threats were made in regards to you. We are a very large company and we do not pride ourselves on bullying anyone into remaining a memeber.""If you choose not to use our third party financing to pay for your clubs we will expect payment in full within ten working days. If you choose not to respond to this notification I am advising you to retain legal counsel.""I don't have the time nor the interest to continue these conversations. This will be handled at the local level." that was on Jan. 2.

All he needed to do was to say that he understood our position and that KiS Golf did not want to force anyone into an unwilling relationship, and that he would be happy ot nullify the application and cancel everything, with no hard feelings. And, should we ever change our minds, hope that we would give them another look. But, he chose a different path.

Yesterday, Jan. 31 we received a statement form their finance source, GE, with a balance due of $5515. This after we had been told by GE that the account had been closed and by Mr. Nance that they would not be billing us. I must also include here that Mr. Kinard has yet to attempt to resolve this with us.

Last evening I had another series of emails with Mr. Nance that ended up with this very unprofessional and somewhat illiterate reply, "You are very strange. You being assertive does not have an impact on company policy. We control of the situation once a contract has been signed. Continuing to email me is not necessary.

I can not help you. I don't have time to continue this non since. I will send you our corp. Attorneys info and you can continue with him."

That was in response to my email to both he and Mr. Kinard that said, "It appears that neither of you understood our earlier communications with you. Today, we have received a statement from your credit provider, GE Money Bank, in the amount of $5515 for membership at KIS GOLF, Concord, NC. We made it quite clear to both of you that this membership was indeed canceled. You went forward and processed the charges anyway, despite our instructions otherwise. No golf clubs were made or delivered. No other items of value have been received from you.

We require written confirmation within the next 24 hours that these charges have been reversed and the account you opened at GE Money Bank has been permanently closed."

I have asked for the full contact information from their CEO, including email. I have emailed Mr. Kinard separately, again, and have not received a response. This is the sleeziest outfit I have encountered in some time. They use the ruse of a golf "Country Club and Training Center" as a cover for a travel club. I cannot understand why they want someone as a customer who does not want to be one, and further, why their President is so intent on making enemies. This cannot bode well for their company.
